RESOLUTION NO. 2009 -66R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />• <br />SAN MARCOS, TEXAS SUPPORTING THE LOOP 82 <br />IMPROVEMENTS PROJECT, INCLUDING AN OVERPASS <br />ABOVE THE UNION PACIFIC RAILROAD LINE, BETWEEN <br />CHARLES AUSTIN DRIVE AND THORPE LANE; <br />AUTHORIZING SUBMISSION OF AN APPLICATION FOR <br />FUNDING OF THE PROJECT BY MEANS OF A PASS <br />THROUGH TOLL AGREEMENT WITH THE TEXAS <br />DEPARTMENT OF TRANSPORTATION (TxDOT); AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the City of San Marcos is proposing improvements to Loop 82, including an <br />overpass above the UPRR rail line, from Charles Austin Drive to Thorpe Lane, and; <br />WHEREAS, this project addresses needed safety and mobility improvements in the Loop <br />82/UPRR area, and; <br />• WHEREAS, completion of these improvements, in addition to safety and mobility benefits, will <br />enhance economic development opportunities in the area through uninterrupted traffic flow <br />above the UPRR rail line, and; <br />WHEREAS, completion of this project will improve quality of life in the region through <br />reductions in traffic congestion, job growth, and a strengthened economic base, and <br />WHEREAS, The City of San Marcos is seeking a Pass-Through Funding Agreement with the <br />Texas Department of Transportation (TxDOT) for this road improvement project whereby the <br />City of San Marcos will provide up-front funding for the projects to be reimbursed by TxDOT, <br />and <br />WHEREAS, Texas State University, Hays County, and the San Marcos Area Chamber of <br />Commerce have expressed support for the proposed Loop 82 improvements and associated new <br />UPRR bridge construction which will bring significant economic and social benefits for the <br />region; <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF SAN MARCOS <br />TEXAS: <br />PART 1.
