Live Music
CUPs for alcohol consumption commonly provide the City a way to regulate amplified live music. The
more recent requests typically have conditions that regulate hours (Plucker's, Wake the Dead, The River
Pub). However, staff is aware of several that do not (Cheatham Street, Bar 141, Tantra). With the
extended hours, live music could potentially be played later.
Revocation Process
Some consideration needs to be given to the revocation process in the LDC. In 2006, the city attempted
a revocation and the license holder argued that the city's process was unfair with regard to witness
examination, notice of violation, and agreement with TABC regulations. The case was settled, and no
ruling was reached. The city should be aware of the possibility of similar objections if the revocation
process is initiated again as the LDC has not been updated. This is important to keep in mind as
extended hours may result in problems with existing CUPs.
