Howard Williams explained that the issue really arises when there is a variance such as those in <br />locations in close proximity to schools. <br />Michael Cosentino said Section 4 can be edited to allow businesses to operate as stipulated <br />under their approved variance or CUP in regard to hours they are allowed to operate. <br />Howard Williams asked if approved, when will the ordinance take effect? <br />Michael Cosentino answered that it will take effect immediately upon passage by the City <br />Council. <br />Allen Shy pointed out that if people want to take their applications straight through to TABC <br />headquarters in Austin, they could bypass the local office and get their application sooner than <br />those who go through the local office. He suggested that someone needs to communicate with <br />TABC headquarters that businesses are required to go through the local TABC office to submit <br />their applications. <br />Brian Montgomery mentioned that Pete Champion said he was going to talk with TABC <br />headquarters. <br />Michael Cosentino suggested that education pieces can say that TABC permits approved <br />before the business can begin serving until 2 a.m. <br />Rick Menchaca said he will call TABC headquarters and talk with Alan Steen, TABC Executive <br />Director, to clarify the process. <br />Allen Shy said he prefers that TABC set batch processing dates and let business owners know <br />the dates ahead of time so they can plan on when to get their applications turned in. Perhaps <br />letters can be sent out to business owners with the batch dates. He agrees to call Pete <br />Champion and follow-up with Rick Menchaca to let him know the status of this proposal. <br />Laurie Moyer said Chuck Swallow will put together a white paper regarding 2 a.m. bar closing to <br />be distributed to business owners after City Council approval of the ordinance on second <br />reading. <br />Rick Menchaca mentioned that staff is still working on parking leasing options with Sanctuary <br />Lofts and Frost Bank as well as looking into valet parking options. <br />Allen Shy said valet companies, themselves, will usually come down and talk with property <br />owners about leasing their parking lots. <br />Kelly Franks recalled when Hill Country Grill went through exploring valet parking, there was not <br />much interest by the valet companies due to liability insurance costs. <br />Allen Shy said valet parking options are good for the Task Force to look at, but thinks the issue <br />should be looked at more carefully by the Economic Development San Marcos Board.
