(b) The fact a conviction is being appealed has no effect on the disqualification of the • applicant or applicant's spouse. (c) The license, if granted, shall state on its face the name of the person to whom it is granted, the expiration date and the address of the sexually oriented business. The license shall be posted in a conspicuous place at or near the entrance to the sexually oriented business so that it may be easily read by a visitor to the premises at any time. (d) A moratorium on the issuance of licenses for sexually oriented business is imposed for a period of time commencing on May 11, 2009 and ending on November 30. 2009 ("the Moratorium Period"). During the Moratorium Period, the Chief of Police shall not accept any applications for sexually oriented business licenses and shall not issue any sexually oriented business licenses, regardless of the date any particular application was filed. During the Moratorium Period, the Planning and Zoning Commission shall study the future land use map, Zoning map, and the text of the Land Development Code and shall forward its recommendations to the City Council concerning the regulation of sexually oriented businesses and the location of such businesses through zoning; SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in is conflict with this ordinance are repealed. SECTION 4. This Ordinance is hereby adopted as an emergency measure and shall take effective immediately upon approval.
