RESOLUTION 2009-68 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A LICENSE AGREEMENT WITH THE <br />EDWARDS AQUIFER AUTHORITY (THE "AUTHORITY") FOR <br />ACCESS ACROSS AND UPON 8.939 ACRES OF LAND OWNED BY THE <br />CITY TO ENABLE THE AUTHORITY TO PROTECT THE INTEGRITY <br />OF, RESTRICT PUBLIC ACCESS TO AND CONDUCT WATER <br />MONITORING AND OTHER INVESTIGATIONS FROM A CAVE <br />LOCATED ON SUCH LAND; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE LICENSE AGREEMENT ON BEHALF OF THE <br />CITY; AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of the attached License Agreement between the <br />City of San Marcos, Texas and the Edwards Aquifer Authority (the "Agreement") are hereby <br />approved. <br />PART 2. The City Manager, Rick Menchaca, is authorized to execute the <br />Agreement on behalf of the City. <br />• PART 3.
