The city may obtain a better rate <br />if we seek competition to supply the power. Mayor Morris stated she <br />thought the City should compare prices. It was consensus of Council <br />to pursue this matter. <br /> <br />Mayor Morris introduced a discussion regarding the results of the <br />Water and Sewer Billing Classification Study and direction to Staff. <br />Lewis McClain reviewed with Council the study in detail and provided <br />alternative rate structures to consider. He stated the system is <br />designed to meet the demands of customers; the city provides the <br />capacity and the size of meters regulates the use of the ?ystem. <br />Mr. McClain reviewed the City's history of rate increases since <br />1984. After reviewing the alternative rate structures with Council, <br />Mr. Clain recommended the city consider Alternative B, which would <br />provide a minimum bill applied to meter size rather than type of <br />customer, i.e., residential, commercial. Mr. Boeker stated this <br />method helps with conservation of usage when we charge by meter <br />size. Mr. McClain stated A~rnative D is a true conservation rate <br />structure which would be easy to administer. He recommended <br />implementing the rate October 1 to provide time to make the <br />necessary computer billing changes and to educate the public as to <br />the change in rate structure. The Council requested examples be <br />provided at the next meeting how Alternative D woulà impact certain <br />customers. <br /> <br />Mayor Morris introduced the city Manager's Report. Mrs. Langenkamp <br />had no report. <br /> <br />Mayor Morris introduced the city Attorney's Report. (1) Mr. Taylor <br />stated Representatives Linebarger and Puente have introduced a water <br />bill, which the city will review to see if we can support it or <br />conditionally support it. Other Aquifer bills have been introduced, <br />but they mostly deal with agriculture. (2) Mr. Taylor stated <br />regarding Judge Bunton' ruling, the Fifth Circuit Court of Appeals <br />in New Orleans has issued a temporary stay. The city will file <br />papers in opposition to the Court of Appeals' issuance. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mr. Moore <br />advised the Council Secretary of Interior, Babbitt, visited San <br />Marcos, and Mr. Moore thought it was a constructive meeting. (2) <br />Ms. Kissler reminded the Council the TML Region VII Meeting will be <br />Friday, Marc~ 26 in Eagle Pass. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, sections 2(e), (f) and (g), V.A.C.S., to discuss pending <br />litgation (Sierra Club vs. Babbitt; city of San Marcos vs. Keith <br />Patterson), contemplated litigation and matters where the city <br />Attorney's ethical duty to the city clearly conflicts with Article <br />6252-17; lease of real property; and duties of a public officer <br />(City Secretary), respectively. Mr. Moore moved to adjourn into <br />Executive Session (9:38 p.m.) and Mr. Guerra seconded the motion, <br />which passed unanimously. <br /> <br />Mr. Guerra moved to reconvene at 10:31 p.m. and Mr. Moore seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING INITIATION OF CONDEMNATION PROCEEDINGS <br />AGAINST THE FREEMAN EDUCATIONAL FOUNDATION TO ACQUIRE A .2296 <br />ACRE PARCEL FOR A WATER TANK PAD SITE, A .350 ACRE TEMPORARY <br />CONSTRUCTION EASEMENT SURROUNDING THE PAD SITE, A .350 ACRE <br />PIPELINE EASEMENT AND A .611 ACRE PUBLIC UTILITY EASEMENT IN <br />CONNECTION WITH THE NORTHWEST WATER SYSTEM IMPROVEMENTS PROJECT <br />IN THE CITY OF SAN MARCOS, TEXAS; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Guerra <br />seconded the motion. Mayor Morris moved to amend the Resolution in <br />Part 3 to add at the end of the sentence, " . . . property no later <br />
