<br />89 <br /> <br /> <br /> <br />Regular Meeting February 8, 1993 Page 7 <br /> <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF TWO VEHICLES FOR THE PUBLIC <br />WORKS DEPARTMENT THROUGH THE STATE PURCHASING PROGRAM; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, EXPRESSING THE CITY'S POSITION ON MANAGEMENT CONCEPTS <br />FOR STATE LEGISLATION PERTAINING TO THE EDWARDS AQUIFER; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration Item 9.B. removed from the <br />consensus agenda, approval of an Ordinance on second reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, REORGANIZING CITY BUILDING CONSTRUCTION REGULATIONS BY <br />CONSOLIDATING BUILDING, GAS, MECHANICAL, PLUMBING, SWIMMING <br />POOL, ELECTRICAL, HOUSING, EXISTING BUILDING AND UNSAFE <br />BUILDING REGULATIONS IN ONE CHAPTER OF THE CODE OF ORDINANCES; <br />ADOPTING THE 1991 STANDARD BUILDING CODE, THE 1991 STANDARD GAS <br />CODE, THE 1991 STANDARD MECHANICAL CODE, THE 1991 STANDARD <br />PLUMBING CODE, THE 1991 SWIMMING POOL CODE, THE 1993 NATIONAL <br />ELECTRICAL CODE, THE 1988 STANDARD EXISTING BUILDING CODE AND <br />THE 1988 STANDARD HOUSING CODE; PROVIDING CERTAIN AMENDMENTS TO <br />THESE CODES; ADOPTING THE AMERICANS WITH DISABILITIES ACT <br />ACCESSIBILITY GUIDELINES; TRANSFERRING FLOOD DAMAGE PREVENTION <br />REGULATIONS FROM CHAPTER 5 TO A NEW CHAPTER lOA; TRANSFERRING <br />PUBLIC RIGHT-OF-WAY CONSTRUCTION AND ACCESS REGULATIONS AND <br />OFF-STREET PAVING STANDARDS FROM CHAPTER 5 TO CHAPTER 25; <br />RETITLING CHAPTER 25 AS "STREETS, SIDEWALKS, RIGHT-OF-WAY <br />CONSTRUCTION AND OFF-STREET PARKING"; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING <br />FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br />EFFECTIVE DATE. ' <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />Mr. Hernandez seconded the motion. Mayor Morris moved to amend the <br />Ordinance as follows: on Page 17 in Section 5-132(d) to read, "(3) <br />Article 333- Armored Cable," on Pages 17 and 18 in Section <br />5-132(d) (~nd (4), to be deleted, on Page 28 to amend Section <br />5-168(c) to read, "(c) In the event of death or disability of a <br />permit holder, the electrical contractor performing the work under <br />the permit will be allowed to complete the work provided that <br />another master electrician assumes responsibility for the work <br />within seventy-two ~ hours of the death or disability," and Mr. <br />Moore seconded the motion, which passed unanimously. The Council <br />then voted unanimously for approval of the Ordinance on second <br />reading. <br /> <br />Mayor Morris introduced the city Manager's Report. Mr. Gilley <br />advised the Council the City of San Marcos was the second largest <br />contributor to the United Way Program this year. Mr. Gilley thanked <br />Mrs. Liner for her help in achieving this contribution for United <br />Way. <br /> <br />. Mayor Morris introduced the City Attorney's Report. Mr. Taylor <br />I stated in the Sierra lawsuit Judge Bunton has given a favorable <br />ruling, and Mr. Taylor thanked the Council for their support. <br /> <br />Mayor Morris introduced the city Council's Report. (1) Mr. Guerra <br />stated he has been appointed as Vice Chair of the NLC Advisory <br />committee and will be speaking next week at the Texas Public Works <br />Association Meeting. (2) Mayor Morris has been appåinted as Vice <br />Chair of the FAIR Steering Committee of NLC. . <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, sections 2(e), (f) and (g), V.A.C.S., to discuss pending <br />litigation (Sierra Club vs Lujan; City of San Marcos vs. Patterson) <br />and matters where the City Attorney's ethical duty to the City <br />clearly conflicts with Article 6252-17¡purchase of real property, <br />exchange of real property; and duties of a public officer (Mayor), <br />
