The marketing efforts will include providing information regarding the program to area <br />lenders, social service agencies, the San Marcos Public Housing Authority, the San Marcos • <br />Area Board of Realtors, and the San Marcos Council of Neighborhood Association <br />members. <br />The City of San Marcos promotes Equal Housing Opportunities in accordance with the <br />Federal Fair Housing Act. Individuals who refuse to rent or <br />sell homes to people based on race, color, national origin, religion, sex, familial status, or <br />disability are violating federal law. <br />Complaints can be filed with the U. S. Department of Housing and Urban Development <br />(HUD) toll free at 1-800-669-9777 (1-800-927-9275 -TDD) or by reporting the violation to <br />the Texas Work Force Commission at 512-437-3850. <br />10. APPLICATION PROCESS <br />A. Prospective applicants should contact the City Development Services Department <br />to discuss their eligibility for program funding. A preliminary screening session will <br />be scheduled. FTH application forms and this policy guideline document will be <br />provided to the applicant. After assessing the information provided in the pre- <br />screening meeting, the City will provide qualified applicants with a preliminary <br />eligibility approval form. This form is NOT a guarantee of funding approval. <br />B. The applicant will schedule an appointment with the lending institute of his/her • <br />choice to obtain pre-approval for a mortgage loan. A copy of the pre-approval letter <br />is to be attached to the FTH application forms and must include a specific maximum <br />loan amount. <br />C. Once the applicant has received a pre-approval letter, the completed FTH <br />application forms and supporting documentation can be submitted to the City for <br />verification of eligibility. <br />D. The applicant must complete a homebuyer's education program that is approved by <br />the City. The applicant must obtain a letter or a certificate indicating completion of <br />the class. This requirement must be completed prior to closing; it is recommended <br />that the applicant complete the training early in the home purchase process. <br />E. The Applicant must provide the address of the home that has been selected to the <br />City in writing. Prior to making an offer on a home, the applicant must provide the <br />seller with the Notice to Real Property Owner/Seller. The seller must acknowledge <br />receipt of the form by signing in the appropriate place on the form. An original copy <br />must be provided to the City. <br />F. The seller must also complete the Seller Certification of Purchase form and the <br />applicant should return a signed copy to the City. <br />G. The applicant should be sure that the earnest money contract is written to allow the <br />applicant to withdraw from the contract with no penalty if the property is not • <br />approved for program assistance. <br />4/09 Revised First-Time Homebuyer's Program Page 8
