(o) Enforcement 0 <br />(a) The city shall have the power to administer and enforce the provisions of this chapter as may <br />be required by governing law. Any person, firm corporation or agent who shall violate a <br />provision of this code, or fails to comply therewith. or with any of the requirements thereof, is <br />subiect to suit for injunctive relief as well as prosecution for criminal violations Any knowing <br />violation of the elements of this ordinance as codified in the City Code is declared to be a <br />nuisance. <br />(b) The city water purveyor can suspend utility service for any violation of this ordinance <br />(c) Any person who knowingly violates any provision of this section shall upon conviction be <br />fined a sum not exceeding $2000.00. Each day that a provision of this section is violated shall <br />constitute a separate offense. <br />(d) An offense under this section is a Class C misdemeanor punishable by a fine of yp to <br />$2000.00. <br />e) Nothing in this section shall be construed as a waiver of the city's right to bring a civil action <br />to enforce the provisions of this section, or any other building code violation and to seek <br />remedies as allowed by law, including, but not limited to the following: is <br />(1) Injunctive relief to prevent specific conduct that violates the ordinance or to require <br />specific conduct that is necessary for compliance with the ordinance; and <br />(2) Other available relief. <br />(f) Whenever a corporation or association violates any provision of this section the president <br />vice-president, secretary, treasurer, manager or any agent or employee of the corporation or <br />association who is responsible for the violation shall be subject to the penalty prescribed for the <br />violation. <br />Fees <br />The city council, by separate ordinance, may create a schedule of fees for obtaining and <br />renewing an irrigation permit. These fees will be in amounts sufficient to cover the city's costs <br />in issuing and renewing the permits, including, but not limited to staff time and other costs <br />Section 3: If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />10 0
