ORDINANCE NO. 2015-43 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DELETING SECTION 62.190 OF THE SAN MARCOS <br />CITY CODE WHICH PROVIDES FOR ASSIGNMENT PAY FOR FIRE <br />DEPARTMENT PERSONNEL PERFORMING SPECIALIZED SERVICES <br />DUE TO INCLUSION OF ASSIGNMENT PAY TERMS IN THE CITY'S <br />MEET AND CONFER AGREEMENT; PROVIDING FOR THE REPEAL <br />OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. On August 20, 2013, the City Council adopted Ordinance No. 2013 -43 providing <br />for assignment pay for Fire Department personnel performing specialized services as an <br />amendment to Section 62.187 of the San Marcos City Code. However, in codifying the <br />amendment, the editor, in its discretion, added the amendment as Section 62.190 for purposes of <br />clarity. <br />2. The City's new Meet and Confer Agreement with the San Marcos Professional <br />Firefighters Association personnel now addresses assignment pay and the provisions of Section <br />62.190 are no longer necessary. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 62.190 of the San Marcos City Code is hereby deleted in its <br />entirety as follows: <br />SECTION 2. In codifying the changes authorized by this ordinance, paragraphs, <br />sections and subsections may be renumbered and reformatted as appropriate consistent with the <br />numbering and formatting of the San Marcos City Code. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />Page 1 <br />
