RESOLUTION NO. 2015-157R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE FILING OF A GRANT <br />APPLICATION WITH THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS FOR A FY 2016 -2017 REGIONAL SOLID WASTE <br />GRANTS PROGRAM GRANT IN THE AMOUNT OF $10,500.00 FOR <br />HOUSEHOLD HAZARDOUS WASTE DISPOSAL COSTS; PLEDGING <br />THAT IF THE CITY RECEIVES A GRANT AWARD IT WILL COMPLY <br />WITH THE GRANT REQUIREMENTS OF CAPCOG, THE TEXAS <br />COMMISSION ON ENVIRONMENTAL QUALITY AND THE STATE OF <br />TEXAS; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO <br />ACT ON BEHALF OF THE CITY IN ALL MATTERS RELATED TO <br />THIS GRANT APPLICATION AND ANY SUBSEQUENT GRANT <br />AGREEMENTS; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Capital Area Council of Governments ( "CAPCOG ") is directed by the Texas <br />Commission on Environmental Quality ( "TCEQ ") to administer solid waste grant funds for the <br />implementation of the CAPCOG'S adopted regional solid waste management plan <br />2. The City is qualified to apply for grand funds under the Request for Applications <br />process. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The filing of a grant application with CAPCOG through the FY 2016/2017 <br />Regional Solid Waste Grants Program in the amount of $10,500.00 for household hazardous <br />waste disposal costs is approved. <br />PART 2. The City Manager or his designee is authorized to request grant funding under <br />the CAPCOG Request for Applications process of the Regional Solid Waste Grants Program and <br />to act on behalf of the City in all matters related to the grant application and any subsequent <br />grant contract and grant project that may result. <br />PART 3. If the project is funded, the City will comply with the grant requirements of <br />CAPCOG, TCEQ, and the State of Texas. <br />PART 4. The grant funds and any grant- funded equipment or facilities will be used only <br />for the purposes for which they are intended under the grant. <br />PART 5. The City's activities regarding any project resulting from this application will <br />comply with and support the adopted regional and local solid waste management plans adopted <br />for the geographical area in which the activities are performed. <br />1 <br />
