Federal and State Agencies generally will not reimburse debris removal activities from private
property and will only reimburse removal of eligible debris as determined by FEMA. County will
not instruct its contractors to remove ineligible debris or debris from private property unless
City has agreed in writing to be responsible for the full cost of such removal and disposal.
2.04 County shall submit to Federal and /or State agencies applications for reimbursement for all
debris picked up by County contractors within city limits. If City has other expenses for debris
removal which were expended outside this Agreement, City shall cooperate with the County to
submit those expenses as a part of the County's application. City shall provide to County, and
thus to the appropriate Federal and /or State agencies, documentation to support such expenses
and to show that such expenses do not duplicate expenses submitted by the County.
2.05 County shall provide regular operational updates on the status of disaster debris removal
operations to include completed areas of disaster debris removal and estimated completion
timelines of the remaining areas.
2.06 The Parties recognize that, during the period of emergency response that has preceded the
effective date of this Agreement, they have cooperated in and around the city limits of the City.
The Parties have consented to perform the preliminary stages of debris removal in a cooperative
manner, and each governmental entity hereby ratifies any actions taken by its agents that may
have provided cooperative assistance within the jurisdiction of the other Party from the date of
the Declarations of Local Disaster issued on May 24, 2015 and October 30, 2015.
ARTICLE III.
HOUSEHOLD HAZARDOUS WASTE
3.01 The County's contracted debris - hauling company will collect any household hazardous waste
found among the flood debris and dispose of it properly. If the County's contracted debris -
hauling company is not able to accommodate the disposal of household hazardous waste, then
the City agrees to receive any household hazardous waste produced from debris collection in
unincorporated areas of the County outside the corporate limits of the City. City's expenses
related to the receipt and processing of household hazardous waste shall be accounted for in
the City's sub - application for reimbursement from the appropriate Federal and /or State
agencies.
3.02 County agrees to ensure that the collection of any household hazardous waste results in the
placement of materials in appropriate receptacles. County agrees to ensure that its contractors
follow proper protocols for the collection of household hazardous waste.
ARTICLE IV.
MUTUAL AID
4.01 The Parties recognize that they have dedicated and will continue to dedicate labor and
equipment toward disaster relief efforts within Hays County. Each Party will continue to
account for its costs associated with disaster relief efforts, and the Parties will collectively
submit their costs for reimbursement from the appropriate Federal and /or State agencies
3
CoSM /Hays — Amended Disaster ILA
