<br /> 4. Adoption of a strict year-round water conservation <br /> ordinance and drought management plan; and, <br />WHEREAS, the Commission has taken the following actions <br />pertaining to the Edwards Aquifer: <br /> 1. Declared the Edwards Aquifer to be an underground <br /> stream, renamed as the "Edwards Underground River"; <br /> 2. Adopted emergency rules providing for interim <br /> authorization for use of state water from the <br /> Edwards Underground River and regulating new <br /> diversions of water from the river; <br /> 3. Established a South-Central Texas Water Resources <br /> Planning Council comprised of representatives of <br /> the state, regional, and local governments, <br /> representatives of the people and enterprises <br /> served directly or indirectly by the Edwards <br /> Underground River, and representatives of <br /> established environmental groups; and, <br /> 4. Pledged to actively support legislation which will <br /> reconstitute the Edwards Underground Water District <br /> as a new regional water authority to manage the <br /> Edwards Underground River; and, <br />WHEREAS, the City of San Marcos has been involved in <br />protracted litigation involving the Edwards Aquifer, including In <br />re: The Ad;udication of Riqhts to the Waters of the Edwards Aquifer <br />and Sierra Club v. Lu;an; and, <br /> <br />WHEREAS, the actions of the Commission described above are an <br />important and valuable step forward in the resolution of the <br />dispute surrounding management of the Edwards Aquifer; now, <br />therefore, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. That the City Council of the City of San Marcos <br />supports the actions of the Texas Water Commission described above <br />as a step forward in the resolution of the dispute over management <br />of the Edwards Aquifer. <br />PART 2. That the City Council hereby pledges its cooperation <br />with the Commission in the development of permanent rules <br />pertaining to regulation of the Edwards Aquifer. <br />PART 3. That the City Council, while supporting the actions <br />of the Commission, nevertheless reaffirms its position as an <br />intervenor in Sierra Club v. Lu;an, the pending suit pertaining to <br />the protection of the endangered species in the San Marcos and <br />Comal Springs and Rivers. <br />PART 4.
