or inaction, or similar causes, provided such similar causes are beyond the reasonable control of <br />the party whose obligations are affected by such acts. <br />"Indenture" means the applicable Indenture of Trust between the City and a trustee <br />relating to the issuance of a series of PID Bonds for financing costs of Public Improvements, as it <br />may be amended from time to time. <br />"Initial Assessment Ordinance" means the ordinance, resolution or order to be adopted <br />by the City County that will levy the Special Assessments associated with the Major Public <br />Improvements. <br />"Initial Owner Expended Funds" has the meaning given in Section 4.02(c) of this <br />Agreement. <br />"Initial Reimbursement Payment" has the meaning given in Section 4.02(c) of this <br />Agreement. <br />"Interest" shall mean the interest rate charged for the PID Bonds or such other interest <br />rate as may be required by applicable law. <br />"Issue Date" means the date of the initial delivery of any of the PID Bonds. <br />"Major Public Improvement PID Bonds" means those certain City of San Marcos, Texas <br />Special Assessment Revenue Bonds, Series [20 ] (Trace Public Improvement District Major <br />Public Improvement Project) that will be secured by Special Assessments levied on an Assessed <br />Parcel in order to fund the Major Public Improvements. <br />"Major Public Improvements" means those Public Improvements that confer special <br />benefit on the entire District and are to be financed with Major Improvement PID Bonds, and as <br />further described in Exhibit D attached hereto and in Table III -A of the Service and Assessment <br />Plan. <br />"Non- Benefited Property" means Parcels within the boundaries of the District that <br />accrue no special benefit from the Public Improvements, including Owner Association Property, <br />Public Property and easements that create an exclusive use for a public utility provider. Property <br />identified as Non - Benefited Property at the time the Special Assessments (i) are imposed or (ii) <br />are reallocated pursuant to a subdivision of a Parcel is not assessed. <br />"Notice" means any notice, writing, or other communication given under this Agreement. <br />"Owner" has the meaning given in the recitals to this Agreement. <br />"Owner's Association" means a homeowner's association or property owner's <br />association. <br />"Owner Association Property" means property within the boundaries of the District that <br />is owned by or irrevocably offered for dedication to, whether in fee simple or through an exclusive <br />31 <br />
