Initial Assessment Ordinance for the purpose of assessing allocated costs against property located <br />within the boundaries of the District having terms, provisions and findings approved and agreed <br />to by the Owner, as required by Article 11 of this Agreement. <br />"Special Assessments" means the assessments levied against properties in the District, as <br />provided for in the applicable Assessment Ordinance and in the Service and Assessment Plan, <br />including any supplemental assessments or reallocation of assessments levied in accordance with <br />Sections 372.019 and 372.020 of the PID Act. <br />"Special Assessment Revenues" means money collected by or on behalf of the City from <br />any one or more of the following: (i) a Special Assessment levied against an Assessed Parcel, or <br />Annual Installment payment thereof, including any interest on such Special Assessment or Annual <br />Installment thereof during any period of delinquency, (ii) a Prepayment, (iii) Delinquent Collection <br />Costs (as defined in the Indenture), and (iv) Foreclosure Proceeds (as defined in the Indenture). <br />"State" means the State of Texas. <br />"Tax Certificate" shall have the meaning given in Section 6.02(a) hereof. <br />"Tax Code" means the Internal Revenue Code of 1986, as amended, including applicable <br />regulations, published rulings and court decisions. <br />"Transfer" shall have the meaning given in Section 2.05(b) hereof. <br />"Transferee" shall have the meaning given in Section 2.05(b) hereof. <br />"Trustee" means the trustee under the Indenture, and any successor thereto permitted <br />under such Indenture and any other Trustee under a future Indenture. <br />"Underwriter" means (Company to be Determined) <br />"Unpaid Balance" shall have the meaning given in the applicable Acquisition and <br />Reimbursement Agreement. <br />34 <br />
