113 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APRIL 23, 1992 PRESENT: Mayor Kathy M. Morris Mayor Pro-Tem Ronald K. Hart Council Members Billy G. Moore Rick Hernandez Fred Guerra Betty Jane Kissler * Bill Plummer city Manager Larry Gilley city Secretary Janis K. Womack City Attorney Mark Taylor Director of MIS Ramona Brown Director of SMEU Bob Higgs Also Present: John Davidson, Melissa Millecam, Collette Boruff and others. Mayor Morris called the meeting to order at 12:30 p.m. Mayor Morris introduced an Executive Session pursuant to Article 6252-17, section 2(e), V.A.C.S., to discuss pending litigation (City of San Marcos vs. LCRA). Mr. Moore moved to adjourn into Executive Session at 12:34 p.m. and Ms. Kissler seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene at 12:47 p.m. and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT BETWEEN THE CITY AND THE LOWER COLORADO RIVER AUTHORITY FOR SETTLEMENT OF THE PENDING LAWSUIT REGARDING PURCHASE OF THE LOCAL ELECTRIC DISTRIBUTION SYSTEM BY THE CITY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Ms. Kissler moved for adoption of the Resolution and Mr. Guerra seconded the motion. Mayor Morris moved to amend the Resolution caption to read: " CONDITIONS OF A COMPROMISE AND SETTLEMENT . . . - - AGREEMENT AND A MUTUAL RELEASE AGREEMENT. . . AUTHORIZING THE MAYOR -- TO EXECUTE THE AGREEMENTS . " PART 1 to read as follows: " . . . , . . . conditions of the Compromise and Settlement Agreement and the Mutual Release Agreement attached. " and PART 2 to read as . . . , follows: "That the Mayor, Kathy ~ Morris, is hereby. . . execute these Agreements . . . . " and Ms. Kissler seconded the motion, , which passed unanimously.
