AMENDMENT NUMBER TWO TO LEASE OF AIRPORT PROPERTY BETWEEN <br />REDBIRD FLIGHT SIMULATIONS, INC. AND THE CITY OF SAN MARCOS <br />STATE OF TEXAS § <br />COUNTIES OF HAYS AND CALDWELL § <br />WHEREAS, Redbird Flight Simulations, Inc. ( "Lessee" or "Redbird ") has assumed the <br />rights and obligations contained in that certain "Lease of Unimproved Airport Property for <br />Construction of Hangar" by and between the City of San Marcos, Texas, a home -rule municipal <br />corporation located at 630 East Hopkins Street, San Marcos, TX 78666 ( "City") originally <br />executed on April 25, 2000. The Lease was approved by Resolution 2000 -95R of the City <br />Council of the City of San Marcos, Texas (which instrument is referred to herein as the "Lease "); <br />and <br />WHEREAS, Redbird has requested that the Lease be amended to expand the Leased <br />Premises to include ground around the hangar for the purposes of vehicular parking and storage; <br />and <br />WHEREAS, City is agreeable to such amendment of the Lease and has agreed to <br />reimburse Redbird for 50% of the cost of the land survey in the form of rent credits; <br />In consideration of the covenants contained in this amendment, the Lessor and Lessee <br />agree to amend the Lease as follows: <br />1) ARTICLE 1. LEASE OF PREMISES; ACCEPTANCE OF EXISTING CONDITIONS; <br />COMPLIANCE WITH REGULATIONS <br />1.01 Article 1. Section 1.01 of the Lease is hereby AMENDED to read as follows: <br />"In consideration of the obligation of the Lessee to pay rent and in consideration of the <br />other terms, covenants and conditions of this Lease, the Lessor leases to the Lessee, and <br />the Lessee leases from the Lessor the 7,667 square foot tract of real property (the "Leased <br />Premises ") in Caldwell County, Texas, described in Exhibit "A" attached to and made a <br />part of this Lease for all purposes." <br />2) ARTICLE 2. RENT/TERM <br />2.01 Article 2. Section 2.02 of the Lease is hereby AMENDED to read as follows: <br />"The Lessee agrees to pay to the Lessor a fixed rental in the sum of $0.20 per <br />square foot per year for the entire area of the Leased Premises.
