1) This Contract is entered into pursuant to the authority granted and in compliance with <br />the provisions of the Interlocal Cooperation Act, Tex. Gov. Code Chapter 791; <br />2) Payments made by DSHS to Contractor shall be from current revenues available to <br />DSHS; and <br />3) Each Party represents that it has been authorized to enter into this Contract. <br />d) Contractor agrees that Contract Revision Requests (pursuant to the Contractor's Request <br />for Revision to Certain Contract Provisions section), when signed by a duly authorized <br />representative of Contractor, shall be effective as of the effective date specified by the <br />Department, whether that date is prior to or after the date of any ratification by <br />Contractor's governing body. <br />Section 1.09 Civil Rights Policies and Complaints. Upon request, Contactor shall provide <br />the Health and Human Services Commission (HHSC) Civil Rights Office with copies of all <br />Contractor's civil rights policies and procedures. Contractor must notify HHSC's Office of Civil <br />Rights of any civil rights complaints received relating to performance under this Contract no <br />more than ten (10) calendar days after Contractor's receipt of the claim. Contractor <br />shall obtain and maintain all applicable licenses, certifications, permits, registrations and <br />approvals to conduct its business and to perform the services under this Contract. Any <br />revocation, surrender, expiration, non-renewal, inactivation or suspension of any such license, <br />certification, permit, registration or approval shall constitute grounds for termination of this <br />Contract or other remedies the Department deems appropriate. Contractor shall ensure that all its <br />employees, staff and volunteers maintain in active status all licenses, certifications, permits, <br />registrations and approvals required to perform their duties under this Contract and shall prohibit <br />any person who does not hold a current, active required license, certification, permit, registration <br />or approval from performing services under this Contract. <br />General Provisions (Core Subrecipient) 2010 5
