S. GILBERT A FRANCHISE TO <br />OPERATE AND MAINTAIN A HORSE-DRAWN CARRIAGE SERVICE WITHIN THE <br />CORPORATE LIMITS OF THE CITY FOR THE PURPOSE OF TRANSPORTING <br />PERSONS UPON PUBLIC STREETS WI~IN THE CITY; STATING THE TERMS, <br />CONDITIONS, OBLIGATIONS AND LIMITATIONS UPON WHICH THE <br />FRANCHISE SHALL BE EXERCISED AND SETTING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />Mr. Hart seconded the motion. Mike Gividen stated there is not <br />sufficient room on the streets to operate this business, and that it <br />will cause traffic and safety problems, and he does not believe the <br />horses are healthy that do this type work. Gail Field stated this <br />business would reflect negatively on San Marcos and would do more <br />harm than good. She hoped the Council would look at this mátter <br />seriously. Nanette Bradley of San Antonio provided the city council <br />with handouts regarding problems associated with this type <br />operation. Ms. Bradley served on the Transportation Advisory Board <br />for six years and for a period of time chaired the board. Ms. <br />Bradley covered some of her concerns which are covered in the <br />materials provided to the Council. The Council assured Ms. Bradley <br />they would review her materials prior to the third reading of the <br />Ordinance. Mr. Moore asked the citizens present who had read the <br />Ordinance, and few had done so. Mr. Gilley stated we could make the <br />Ordinance available in the foyer for those who wished to have <br />copies. Ms. Kissler stated she was concerned about some of the <br />streets where the business would operate. Ms. Kissler stated she <br />received a call from a citizen concerned the City was getting this <br />business in lieu of a transit system, and Ms. Kissler assured them <br />this was not the case. Mike Gividen stated the City should check <br />the route through the historical districts just to see if the <br />streets could accommodate this business. R. G. Phillips stated it <br />is preposterous for the city to consider this business in San <br />Marcos. Mr. Hart asked if the horse certification could include <br />good health. Mr. Taylor suggested the City could require the horses <br />to be certified more often, the City could place a limitation on how <br />many hours the horses worked per day, at what temperature the horses <br />would be prohibited from working, and we could designate what <br />veterinarian is used for the examinations. Mr. Hart moved to amend <br />the Ordinance to include the last sentence in section 5 on Page 2 of <br />the Ordinance and for that wording to be amended to include the City <br />designating the veterinarian to be used for examinations with the <br />cost to be borne by the operator, and Mr. Plummer seconded the <br />motion, which passed unanimously.
