<br /> 162 <br />Regular Meeting August 24, 1992 Page 7 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br /> BETWEEN THE CITY AND THE LOWER COLORADO RIVER AUTHORITY FOR <br /> TECHNICAL SERVICES FOR THE SAN MARCOS ELECTRIC UTILITY; <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ACCEPTING A GRANT OFFER FROM THE FEDERAL AVIATION <br /> ADMINISTRATION FOR PROJECT NO. 3-48-0195-09 AT THE SAN MARCOS <br /> MUNICIPAL AIRPORT, APPROVING THE TERMS AND CONDITIONS OF THE <br /> GRANT AGREEMENT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE <br /> DATE. <br />Mayor Morris introduced the City Manager's Report. (1) Acting City <br />Manager, Ron Patterson, advised the Council the funeral services for <br />Mrs. O. S. Gilley were scheduled for Wednesday at noon, and the <br />family requested donations to the Community Hospice of st. Joseph in <br />Fort Worth in lieu of flowers. (2) Mayor Morris provided the <br />Council with a schedule for the next bond issue in Mr. Gilley's <br />absence. <br />Mayor Morris introduced the City Attorney's Report. Mr. Xaylor <br />advised there would be a delay in presentation of the Curfew <br />Ordinance due to an opinion issued by the Federal District Court in <br />the Northern District out of Dallas ruling the Dallas Ordinance <br />unconstitutional. Mr. Taylor is reviewing the opinion and <br />activities of other Ordinances (Fort Worth repealing their <br />Ordinance, San Antonio studying data). In the ruling issued, you <br />have to have evidence of a need for a curfew and over a period of <br />time show the Ordinance has an impact. Mr. Taylor has discussed <br />with Tom Martin some of the information that would be needed from <br />their records. The Council request~d there be stepped-up <br />enforcement in the Downtown area, particularly Thursday, Friday and <br />Saturday nights. <br />Mayor Morris introduced the City Council's Report. (1) Mayor Morris <br />stated she had received information from the Office of Budget and <br />Management advising the possibility of changing their statement of <br />Austin, Texas M.S.A. to Austin-San Marcos M.S.A. Mayor Morris <br />encouraged letters and calls of support be made. She did not know <br />when their decision would be made, but it would be great for San <br />Marcos if they change the title. (2) Mr. Hernandez advised the <br />Council TAMACC did not select San Marcos for its next quarterly <br />meeting in January. <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, Section 2(e), V.A.C.S., to discuss matters where the duty <br />of the City Attorney to the City pursuant to the Code of <br />Professional Responsibility of the State Bar of Texas clearly <br />conflicts with Article 6252-17. Mr. Moore moved for adjournment <br />into Executive Session at 9:32 p.m. and Mr. Plummer seconded the <br />motion, which passed unanimously. <br />Mr. Guerra moved to reconvene at 10:45 p.m. and Mr. Moore seconded <br />the motion, which passed unanimously. <br />The meeting adjourned at 10:47 p.m. on motion made by Mr. Guerra and <br />seconded by Mr. Hernandez. <br /> í~ ;l{h <br /> ¡ v '¿~/Lt1 <br />FJ~. ~ <br />lly G. <br /> . <br />Ronald K.
