codes of technical societies that have been adopted by law, relating to the Work. <br />This Agreement shall be governed in its interpretation and enforcement by the laws <br />of the State of Texas, without regard to its conflicts of law provisions. Unless <br />exclusive venue is established by law elsewhere, venue of any lawsuit shall be in a <br />court of competent jurisdiction in Travis County, Texas. <br />25. Insurance. The LCRA shall contractually require each person or <br />entity with whom it subcontracts to provide services on the Project, to carry <br />insurance coverages in the forms and limits set out below. The coverages shall not <br />be construed as establishing or limiting LCRA's liability under this Agreement. <br />Coverage shall be written on an occurrence basis by companies authorized and <br />admitted to do business in the State of Texas and rated A- or better by A.M. Best <br />Company or otherwise acceptable to LCRA. <br />a) Commercial General Liability <br />Bodily Injury $1,000,000 per occurrence, Property Damage $500,000 per <br />occurrence, Products Liability $1,000,000 per occurrence <br />b) Automobile Liability (including owned or leased vehicles) <br />Bodily Injury $1,000,000 per occurrence, Property Damage $500,000 per <br />occurrence <br />c) Workers' Compensation <br />Coverage A — statutory amounts <br />Coverage B - $500,000 employer's liability <br />Insurance requirements may be satisfied in whole or in part by a program of <br />self- insurance or self- insured retention amounts. San Marcos, for itself and its <br />insurers, hereby waives subrogation against LCRA, its directors, officers, employees <br />and agents. LCRA shall obtain from each third person or entity providing services on <br />the Project, and provide to San Marcos upon request, a certificate of coverage, prior <br />to that person or entity beginning work on the Project. LCRA shall retain all required <br />certificates of coverage for the duration of the Project and for one year thereafter. <br />LCRA shall post, or cause to be posted, on the Project site a notice, in the <br />text, form, and manner prescribed by the Texas Department of Insurance, Division of <br />Workers Compensation, informing all persons providing services on the Project that <br />they are required to be covered, and stating how a person may verify workers <br />compensation coverage and report lack of coverage. <br />26. General Safety. LCRA shall perform this Agreement in a safe and <br />healthy manner and shall comply with and enforce all applicable laws, rules, <br />regulations and industry practices relating to worker safety and health. If personnel <br />of both Parties are working at the Project site, both Parties shall cooperate to <br />achieve job premises safety. LCRA is responsible for coordinating with the proper <br />authorities for moving heavy equipment, location of underground utilities, erecting <br />barricades, traffic control, and other safety measures, unless otherwise specified in <br />the SOW. <br />Interlocal Agreement for Solar Energy Facility <br />LCRA —San Marcos page 6 <br />
