90 <br />Regular Meeting December 4, 1995 Page 2 <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. <br />Mayor Morris introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider the <br />Ordinance. The caption of the Ordinance reads as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, '. <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 10.00 ACRE TRACT OF PROPERTY LOCATED NEAR THE INTERSECTION OF <br />RIVER ROAD AND STATE HIGHWAY 80, FROM "MF-4" (MULTI-FAMILY <br />DISTRICT [HIGH DENSITY]) TO "C" (COMMERCIAL DISTRICT) AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Morris introduced for consideration approval of the minutes of <br />the Regular Meeting held November 27, 1995, adoption of an ordinance <br />on third and final reading, and adoption of six Resolutions on <br />consensus. The Council removed Items 7.C.(1) and 7.C.(2), adoption <br />of Resolutions, to be considered separately: Mr. Hart moved for <br />approval of the minutes of the Regular Meeting held November 27, <br />1995, adoption of the ordinance on third and final reading and <br />adoption of the remaining four Resolutions by consensus and Mr. <br />Moore seconded the motion, which passed unanimously. The captions <br />of the ordinance and Resolutions read as follows: <br />Adoption of Ordinance on third and final reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, CHANGING THE NAME OF HUTCHISON STREET TO RIO VISTA <br />STREET BETWEEN HAYNES STREET AND IH-35 NORTH; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br />Adoption of Resolutions: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE RELEASE AND QUITCLAIM OF A PORTION OF THE <br />CITY ELECTRICAL EASEMENTS LOCATED ON REAL PROPERTY OWNED BY <br />LAQUINTA INNS, INC. AT 1619 IH-35 NORTH; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE A QUITCLAIM DEED; AND DECLARING AN EFFECTIVE <br />DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE SALE OF AN EASEMENT TO CENTURY TELEPHONE <br />OF SAN MARCOS FOR A REMOTE SWITCHING SHELTER WITHIN THE HILLTOP <br />POWER SUB-STATION ON RAMSAY STREET; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE EASEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LICENSE <br />AGREEMENT BETWEEN THE CITY AND CENTURY TELEPHONE OF SAN MARCOS <br />FOR AN AREA OF PROPERTY WITHIN THE HILLTOP POWER SUB-STATION ON <br />RAMSAY STREET; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br />BETWEEN THE CITY AND SOULES AND WALLACE FOR REPRESENTATION OF _ <br />THE CITY IN THE KENCON CONSTRUCTORS LAWSUIT REGARDING THE SAN <br />MARCOS PUBLIC LIBRARY PROJECT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />Mayor Morris introduced for consideration Item 7.C.(1) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows:
