92 <br />Regular Meeting December 4, 1995 Page 4 <br />Rich's property is annexed and added to the tax roll, the City would <br />realize $1,200.00 per year. There are four additional City <br />properties that could be served by this extension. Mr. Friche's <br />property is located between the old Walmart and the proposed new <br />location for Walmart (wants wastewater). The Schawe's and Serna's <br />properties could also be served by this extension. The Council <br />requested more information be provided regarding what citizens could <br />utilize this extension and the cost to add Mr. Friche to the system. <br />Mayor Morris introduced a discussion regarding the San Marcos <br />Horizons Master Plan. Mr. Ron Patterson reviewed with Council a <br />handout, which is attached to these minutes. <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />advised the Council the Sights and Sounds of Christmas was an <br />outstanding success. Mr. Gilley thanked Staff for preparing and <br />participating in the event. (2) Mr. Gilley advised the Council <br />Robert Wynn of Frost Bank has closed the property transaction with <br />SWTSU. (3) Mr. Gilley advised the Church has delivered a letter to <br />the City Secretary advising the City they will not be fulfilling the <br />obligation of the security with their bid on the church property, <br />and therefore, the bid is automatically rejected. <br />Mayor Morris introduced the City Attorney's Report. (1) Mr. Taylor <br />advised the Council the first reading on adoption of the City Code <br />would be January 8, 1996. (2) Judge Bunton has issued an order in <br />the Federal Endangered Species suit favorable to the City that <br />brings us closer to judicial regulation of the Aquifer. However, <br />the order will not take effect until the Federal Appellate Court in <br />New Orleans allows it to do so. They have not yet ruled on this <br />matter. <br />Mayor Morris introduced the City Council's Report. (1) Mr. Moore <br />stated Messrs. Mooney, Cox and Hernandez attended the University <br />Caucus Meeting. Two of the issues addressed were drunk driving and <br />the hospitality business. (2) Mr. Hernandez announced many have <br />been wondering about his political future with the City, and that he <br />would not be seeking the County Commissioner seat but would remain <br />with the City. (3) Mr. Moore stated Mr. Hernandez was elected to <br />the Board of Directors of the Hispanic Elected Local Officials at <br />the National League of Cities Conference in Phoenix, Arizona. (4) <br />Mayor Morris stated at the National League of Cities Conference, <br />recommendations will be sent to the President to establish a 1-800 <br />number so citizens can provide messages to the President regarding <br />the need for a balanced budget. The NLC-FAIR Committee established <br />goals to balance the budget which will be forwarded to the <br />President. <br />Mayor Morris introduced an Executive Session pursuant to Section <br />551.071, to discuss pending litigation (Sierra Club vs. Babbitt; <br />Medina County U.W.C.D. vs. Barshop; Kencon Constructors vs. City of <br />San Marcos) and matters where the City Attorney's ethical duty to <br />the City clearly conflicts with Government Code Chapter 551 <br />(Aquarena Springs property taxation). Mr. Mooney moved to adjourn <br />into Executive Session at 9:27 p.m. and Mr. Moore seconded the <br />motion, which passed unanimously. <br />Mr. Guerra moved to reconvene at 10:08 p.m. and Mr. Hernandez <br />seconded the motion, which passed unanimously. <br />The meeting adjourned at 10:08 p.m. on motion made by Mr. Guerra and <br />seconded by Mr. Mooney. <br />Billy G.
