RESOLUTION 2009-82R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS FINDING TWO 2002 FORD EXCURSIONS UTILIZED <br />BY THE CITY'S POLICE DEPARTMENT TO BE SURPLUS AND OF NO <br />VALUE TO THE CITY OF SAN MARCOS; AUTHORIZING THE <br />POLICE DEPARTMENT TO DONATE THESE TWO VEHICLES TO <br />TEXAS STATE UNIVERSITY FOR USE IN THE ADVANCED LAW <br />ENFORCEMENT RAPID RESPONSE TRAINING PROGRAM; <br />TRANSFERING TITLE FOR BOTH VEHICLES TO TEXAS STATE <br />UNIVERSITY; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. Two 2002 Ford Excursions (the "vehicles") were acquired by the City with grant <br />funding from the Governor's Criminal Justice Division, Advanced Law Enforcement Rapid <br />Response Training ("ALERRT") Program when the City was the principal grantee. <br />2. These vehicles are owned by the City and have been used exclusively for the <br />ALERRT Program. <br />3. Texas State University now manages the ALERRT Program and has had <br />possession of the vehicles for several years. Texas State University has continued to use the <br />• vehicles for the ALERRT Program and has been responsible for the operation costs, such as fuel <br />and repairs. <br />4. The original grant restrictions require that the vehicles be used only in conjunction <br />with the ALERRT Program. Therefore, the City cannot reassign the vehicles to other duties or <br />sell the vehicles which render the vehicles surplus and of no value to the City. <br />5. The City wishes to transfer the titles of the vehicles to Texas State University <br />which will remove the vehicles from the City's fleet and resolve insurance coverage issues. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Council finds and determines that two 2002 Ford Excursions, Unit <br />#202A, VIN# 1FMNU40L12E1366007 and Unit #918A, VIN# IFMNU40L22EB16491 which <br />were purchased using grant funding for the ALERRT Program are surplus and of no value to the <br />City of San Marcos. <br />PART 2. The Police Department is authorized to transfer title to and to donate these <br />vehicles to Texas State University for the ALERRT Program. <br />PART 3. The City Manager, Rick Menchaca, is authorized to execute any necessary <br />0
