ORDINANCE NO. 2016-09 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING CHAPTER 14, ARTICLE 8 <br /> OF THE SAN MARCOS CITY CODE CREATING LOCAL <br /> AMENDMENTS TO THE 2015 INTERNATIONAL PROPERTY <br /> MAINTENANCE CODE BY ADDING SECTIONS 305.3.1 AND <br /> 305.3.2 REGARDING DISINFECTION OF PREMISES <br /> FOLLOWING FLOOD EVENTS; PROVIDING A SAVINGS <br /> CLAUSE; PROVIDING FOR THE REPEAL OF ANY <br /> CONFLICTING PROVISIONS; AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City of San Marcos ("City") has experienced several major flood events in recent <br /> years. <br /> 2. The City recognizes a local need for remediation and disinfection of properties <br /> subjected to harmful flood waters and its effects. <br /> 3. The City intends to utilize this ordinance in concert with the existing rules and <br /> regulations of the United States Department of Health and Human Services and other <br /> regulatory organizations to help protect the health, safety and welfare of our citizens after <br /> a flood event. <br /> 4. The City Council adopted the 2015 International Property Maintenance Code with the <br /> passage of Ordinance No. 2015-21, which Code can be amended by local ordinances. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. Chapter 14, Article 8, International Property Maintenance Code is <br /> amended by adding Sections 305.3.1 and 305.3.2 as follows: <br /> 305.3.1 Owners or managers of rentals properties identified by damage assessment teams <br /> to have been flooded in any declared emergency or declared disaster related to any flood <br /> event must disinfect or cause disinfection of all interior surfaces used for habitation. <br /> Disinfection must be performed before re-occupancy is allowed inside the habitation or <br /> residence following a flood event. <br /> 305.3.2 The owner or manager of a habitation covered by 305.3.1 shall provide proof to <br /> the code official or the code official's designee, upon request, that the residence or <br /> habitation was disinfected, the means by which the property was disinfected, and when <br /> disinfection occurred. <br />
