109 <br />Regular Meeting April 24, 1995 Page 5 <br />Mayor Morris introduced the report from Black and Veatch regarding <br />phosphates. Bill Davis provided the Council with a handout and <br />reviewed its contents regarding what would be the effect of <br />elimination of phosphorous from the river. He stated it will take a <br />multi-year study to know what effect the reduciton would have and <br />thinks other effects are part of the problem too. Mr. Davis stated <br />he does not advise the City to put phosphorous removal at the <br />Wastewater Treatment Plant today. A copy of the Black and Veatch <br />report is attached to these minutes. <br />Mayor Morris introduced the City Manager's Report. Mr. Gilley had <br />no report. The Council made reference to a letter from GBRA and who <br />could represent the City. Mr. Cox stated he could on May 2, and Mr. <br />Gilley also indicated he would send a staff representative. <br />Mayor Morris introduced the City Attorney's Report. Mr. Taylor had <br />no report at this meeting. <br />Mayor Morris introduced the City Council's Report. (1) Mayor Morris <br />stated Mr. Mooney has requested information from the City Attorney <br />regarding revision to the Solicitation Ordinance, and did the <br />Council want to look at amendment. It was consensus of Council not <br />to amend the Ordinance at this time. (2) Mayor Morris asked the <br />Council if they were interested in supporting bicycle helmet laws <br />legislation. It was consensus of Council to only monitor the bill. <br />(3) Mayor Morris stated the Parkway Association is endorsing the <br />railroad loop. It was consensus of Council to support the railroad <br />loop and to forward this to the railroad. (4) The Council was <br />advised Staff's survey regarding LBJ and Chestnut did not warrant <br />multi-way stop signs, and if the Council wants signs placed, to let <br />Mr. Gilley know. (5) Mayor Morris stated in reference to the <br />utility legislative matters the PUC bills regarding universities' <br />electric service would effect our service. The City is not <br />supportive of legislation that would reduce our tariffs to them. <br />(6) Mayor Morris attended a Caldwell County Commissioners Court <br />meeting. She advised the Judge and Commissioners San Marcos wants <br />to work with them, and we will provide information to them regarding <br />the extension of our runway. Mr. Gilley was directed to provide <br />them with information. (7) Mr. Guerra stated SWT was going to be <br />fine with the utility line item. (8) Mr. Hernandez attended the <br />Spurs Game last Friday representing the City. He said it was very <br />enjoyable and about 93 San Marcans went in two buses and more in <br />cars. <br />Mayor Morris introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss pending litigation <br />(Sierra Club vs. Babbitt) and matters where.the City Attorney's <br />ethical duty to the City clearly conflicts with Government Code <br />Chapter 551. Mr. Guerra moved the Council adjourn into Executive <br />Session at 9:44 p.m. and Mr. Hernandez seconded the motion, which <br />passed unanimously. <br />Mr. Hart moved the Council reconvene at 11:08 p.m. and Mr. Guerra <br />seconded the motion, which passed unanimously. <br />The Council adjourned at 11:15 p.m. on motion made by Mr. Hernandez <br />and seconded by Mayor Morris. <br />bert Mooney <br />C unci mber <br />t <br />F ed G rra <br />Mayor Pro-Tem <br />Kathy M Morris <br />Mayor <br />.
