RESOLUTION NO. 2016-63R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS OBJECTING TO THE INCLUSION OF ANY <br />PORTION OF THE CITY LIMITS OF THE CITY OF SAN MARCOS IN <br />THE PROPOSED EMERGENCY SERVICES DISTRICT NO. 9; <br />CONSENTING TO THE INCLUSION OF TERRITORY WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY OF SAN <br />MARCOS IN THE PROPOSED EMERGENCY SERVICES DISTRICT <br />NO. 9; AND DECLARING AN EFFECTIVE DATE. <br />Recitals: <br />1. On March 16, 2016 the City of San Marcos, Texas received a petition for creation of <br />Hays County Emergency District No. 9 to include both the city limits of the city and <br />territory within the city's extraterritorial jurisdiction. <br />2. According to Section 775.014 of the Texas Health and Safety Code, the governing body <br />must act on the request within sixty (60) days or the request will be denied. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The San Marcos City Council hereby opposes the inclusion of any territory <br />within the city limits of the City of San Marcos, Texas in the proposed Hays County Emergency <br />Services District No. 9. <br />PART 2. The San Marcos City Council hereby consents to the inclusion of territory <br />within the extraterritorial jurisdiction of the City of San Marcos, Texas in the proposed Hays <br />County Emergency Services District No. 9. <br />PART 3.
