commencement of construction activities. The CSN shall be <br />submitted to the MS4 Operator. If the construction activity is <br />already underway upon the effective date of this Division, the CSN <br />shall be submitted within thirty_ (30) days. For stormwater <br />discharges from construction sites where the operator changes, the <br />new operator shall submit a CSN to the City at least two (2)days <br />prior to commencing work at the site. <br />(2) A Stormwater Pollution Prevention Plan (SWPPP) shall be <br />prepared and implemented in accordance with the requirements of <br />the Construction General Permit (TXR 150000) or any individual <br />or group TPDES permit issued for stormwater discharges from the <br />construction site, and with any additional requirement imposed by <br />or under this Division and any other City ordinance. All SWPPP <br />documents shall be designed and signed by a Licensed <br />Professional Engineer (Texas) with competence in this area as <br />required by Texas Engineering Practice Act, Section 137, a <br />Certified Professional in Erosion and Sedimentation Control <br />(CPESC), or other registered/certified professional with <br />competence in this area. <br />The SWPPP shall be completed prior to the submittal of the CSN <br />to the City of San Marcos and prior to the commencement of <br />construction activities. The SWPPP shall be updated and modified <br />as appropriate and as required by the Construction General Permit <br />and this Division. <br />(4) All contractors and subcontractors identified in a SWPPP shall <br />sign the SWPPP in accordance with the Construction General <br />Permit. <br />The SWPPP and any modification thereto shall be retained at the <br />construction site from the date of commencement of construction <br />through the date of final stabilization and shall be made available <br />to the City of San Marcos upon request (as well as to EPA and <br />TCEQ inspectors). <br />The City of San Marcos may the operator at any time that <br />the SWPPP does not meet the requirements of the Construction <br />General Permit, any applicable individual or group TPDES permit <br />issued for stormwater discharges from the construction site, or any <br />additional requirement imposed by or under this Division. Such <br />notification shall identify those provisions of the permit or <br />ordinance which are not being met by the SWPPP, and identify <br />which provisions of the SWPPP require modifications in order to <br />meet such requirements.
