are eliminated, or where the operator of all stormwater discharges <br />at a facility changes, the operator of the construction site shall <br />submit to the City of San Marcos a completed small CSN in <br />accordance with the Construction General Permit. The completed <br />small CSN shall be submitted to the MS4 Operator. <br />(c) Disturbances of Five Acres or More. All operators of large <br />construction activities, including demolition, clearing, rg ading, and excavation <br />activities that result in the disturbance of five or more acres of total land area or <br />that are part of a common plan of development or sale within which five or more <br />acres of total land area are disturbed, or who are required to obtain a TPDES <br />permit for stormwater discharges associated with construction activity, shall <br />comply with the following requirements in addition to those in subsection (a): <br />Any perator who intends to obtain coverage for stormwater <br />discharges from a construction site under TXR150000 TPDES <br />General Permit for Stormwater Discharges from Construction <br />Sites, commonly referred to as the Construction General Permit, <br />shall submit a signed copy of the Notice of Intent (NOI) to the <br />TCEQ at least seven (7) days prior to the commencement of <br />construction activities, or if utilizing electronic submittal, rip or to <br />commencing construction activities. For stormwater discharges <br />from construction sites where the operator changes, the new <br />operator shall submit an NOI to TCEQ at least ten (10) days prior <br />to the transfer of operational control, in accordance with the <br />Construction General Permit. Primary operators shall complete and <br />post a TCEQ Large Construction Site Notice (CSN) and Secondary <br />Operators shall complete and post a CSN. <br />(22,) A copy of any NOI that is required by Section 86.529(c)(1) shall <br />be submitted to the City in n conjunction with any application for a <br />development permit and any other City approval necessary to <br />commence or continue construction at the site. The completed and <br />signed NOI shall be submitted to the MS4 Operator. <br />(33) A Stormwater Pollution Prevention Plan ( SWPPP) shall be <br />prepared and implemented in accordance with the requirements of <br />the Construction General Permit (TXR 150000) or any individual <br />or groa TPDES permit issued for stormwater discharges from the <br />construction site, and with any additional requirement imposed by <br />or under this Division and any other City ordinance. All SWPPP <br />documents shall be designed and signed by a Licensed <br />Professional Engineer (Texas) with competence in this area as <br />required by Texas Engineering Practice Act, Section 137, a <br />Certified Professional in Erosion and Sedimentation Control <br />
