On April 12, 2016 the City Planning and Zoning Commission conducted a public <br />hearing on an application requesting the abandonment of an eight foot by 172 foot, more or less, <br />section of Patton Street west of Gravel Street, as shown in Exhibit "A" (the "Street Section ") and <br />voted to recommend City Council approval of the request, subject to conditions as approved by the <br />Commission. <br />2. The fair market value of the Street Section, as established by an appraisal, is <br />$1,543.00. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The abandonment of the Street Section is approved, subject to the following <br />conditions: <br />a. that a public utility easement be reserved across the entirety of the Street <br />Section, except for the portion upon which the foundation of the existing residential structure <br />at 804 Gravel Street is located; <br />b. that the abutting owner at 804 Gravel Street remove all fences within the <br />Street Section; and <br />C. that the owner of such abutting property replat the property to combine it with <br />the Street Section. <br />SECTION 2. Subject to the conditions stated in Section 1, the City Manager is authorized to <br />execute a quitclaim deed conveying the Street Section to the owner of the abutting lot at 804 Gravel <br />Street upon payment by such owner of the fair market value of the Street Section to the City. <br />
