On April 12, 2016 the City Planning and Zoning Commission conducted a public hearing on an application requesting the abandonment of an eight foot by 172 foot, more or less, section of Patton Street west of Gravel Street, as shown in Exhibit "A" (the "Street Section ") and voted to recommend City Council approval of the request, subject to conditions as approved by the Commission. 2. The fair market value of the Street Section, as established by an appraisal, is $1,543.00. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The abandonment of the Street Section is approved, subject to the following conditions: a. that a public utility easement be reserved across the entirety of the Street Section, except for the portion upon which the foundation of the existing residential structure at 804 Gravel Street is located; b. that the abutting owner at 804 Gravel Street remove all fences within the Street Section; and C. that the owner of such abutting property replat the property to combine it with the Street Section. SECTION 2. Subject to the conditions stated in Section 1, the City Manager is authorized to execute a quitclaim deed conveying the Street Section to the owner of the abutting lot at 804 Gravel Street upon payment by such owner of the fair market value of the Street Section to the City.
