Mr. Cox moved to amend the Contract on Page 3 in <br />Section 5.04 in the second complete sentence to read, "Seller and <br />Buyer shall each pay 50% (not to exceed $1,500 each) towards the <br />cost of this report," and Mr. Guerra seconded the motion, which <br />passed unanimously. Mayor Morris moved to amend Section 5.04 in the <br />third complete sentence to read, "Should the report identify <br />required remediation, Seller may choose to fully perform such <br />remediation at its sole expense prior to closing, or Seller may <br />refuse to do so, in which case Purchaser may cancel this contract," <br />and Mr. Hart seconded the motion, which passed unanimously. The <br />Council then voted unanimously for adoption of the Resolution. <br />Mayor Morris introduced a discussion regarding a report from RAM <br />Communications Consultants on their assessment of the radio system <br />needs of the city and funding sources identified and direction to <br />Staff. Chief Kendrick stated the City is in need of additional <br />frequencies. Tom Sharp of RAM Communications stated an RFP could be <br />provided within two months, which would cover the City and three to <br />five miles beyond. The Council asked if there were any benefits to <br />doing this on a regional basis, to which Mr. Sharp replied he did <br />not think there would be a significant cost savings'to doing this <br />regionally. The current channels are congested and have <br />limitations. The Council requested additional information be <br />provided the first meeting in February regarding if other entities <br />will commit, financial arrangements and firm sources to pay for the <br />system (feasibility of using drug money and CAPCO). <br />Mayor Morris introduced the City Manager's Report. Mr. Gilley <br />stated Dave Marsh of CARTS would provide an update on the <br />transportation system at the next meeting. The same day he will <br />conduct a public hearing at 5:00 p.m. to receive additional public <br />input. If the Council is interested 'in looking at Lufkin Transit <br />System before that time, arrangements can be made. <br />Mayor Morris introduced the city Attorney's Report. Mr. Taylor had <br />no report at this meeting. <br />Mayor Morris introduced the city Council's Report. (1) Mr. Cox <br />requested the status of the Crockett School traffic issue, and Mr. <br />Gilley stated he has talked with the School District and IST funding <br />is available for sidewalks to deal with that problem. Mr. Gilley <br />stated we need to look at all the school campuses and the traffic <br />associated around them. (2) The meeting with the Sunset Acres <br />Neighborhood regarding street and water/wastewater improvements will <br />be January 19 at the Broadway Street Fire Station. The neighbors <br />will be advised of the meeting through a flyer. (3) Mr. Cox stated <br />Mr. Moore has been in communication with Dennis Allen of SWTSU <br />regarding grade separation of the railroad tracks. Mr. Allen will <br />be attending a Neighborhood Council Meeting to be held at Dunbar on <br />January 12 and will be discussing traffic community problems. <br />Mayor Morris introduced an Executive Session pursuant to section 551 <br />of the Government Code, section 551.071, to discuss pending <br />litigation (Sierra Club vs. Babbitt) and matters where the city <br />Attorney's ethical duty to the City clearly conflicts with <br />Government Code Chapter 551; and sections 551.072 and 551.073, to <br />discuss purchase of real property.
