The Ethics Review Commission has recommended a revision to <br />section 2-73(c) of the City's Code of Ethics ordinance to limit the <br />restrictions on city officers appearing in their private capacities <br />before City departments, agencies, boards and commissions of which <br />they are not members to city Council members. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY .OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That section 2-73(c) of the San Marcos Code of <br />Ordinances is amended, and section 2-73(e) of the San Marcos Code <br />of Ordinances is added, to read as follows: <br /> <br />(c) No city council member shall knowingly represent any <br />private person including the council member or any immediate <br />family member, or any group or interest before any department, <br />agency, commission or board of the city, except that council <br />members may represent their interests in their owner-occupied <br />homesteads before a boardr agency, commission or department of <br />the city other than the city council. <br /> <br />(e) A member of the planning and zoning commission shall <br />not knowingly represent the member or any other person, group <br />or interest before the zoning board of adjustments on any <br />matter involving land use or development, and a member of the <br />zoning board of adjustments shall not knowingly represent the <br />member or any other person, group or interest before the <br />planning and zoning commission on any matter involving land <br />use or development. These restrictions do not apply to <br />members representing their interests in their owner-occupied <br />homesteads. <br /> <br /> <br />SECTION 2. That if any wordr phraser clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br /> <br />SECTION 5. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published In a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading June 13, 1994. <br />
