The city Planning commission considered amendments to Article <br /> IV, section G.4 of the city Subdivision Ordinance, regarding the <br /> types of construction permits that are issued for work on existing <br /> buildings on'unplatted property on February 8, 1994, March 8, 1994 <br /> and March 29, 1994. <br /> 2. The Planning commission has recommended that the City Council <br /> adopt the amendments on this subject included in this ordinance. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: ~ <br /> SECTION 1. That Article IV, section G.4 of Appendix C, <br /> Subdivision Ordinance, of the San Marcos Code of Ordinances is <br /> amended to read as follows: <br /> 4. No construction permits shall be issued for any <br /> building, structure, or septic tank on a property for <br /> which a plat has not been approved and filed for <br /> record with the following exceptions: <br /> a. Permits for repair,. remodeling and expansion of <br /> existing buildings, if the current boundaries of <br /> the property existed in the same configuration on <br /> March 10, 1975, and the director of public works <br /> has determined that the existing city <br /> infrastructure is adequate to serve the building <br /> and the proposed improvements. The cumulative area <br /> of building expansions allowed under this <br /> subsection is limited to 50% of the original floor <br /> area of single-family and duplex residential <br /> structures, and 15% of the original floor area of <br /> multi-family residential and all non-residential <br /> structures. <br /> b. Permits for accessory buildings not connected to <br /> wastewater service. <br /> c. Demolition permits. <br /> SECTION 2. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 4. That any person violating any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor and upon <br /> conviction shall be subject to the penalty provided in section 1-5 <br /> of the San Marcos Code of Ordinances. <br /> SECTION 5.
