<br /> 7 <br /> RESOLUTION 1994- 109 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING A RELEASE OF SURETY FORM <br /> IN CONJUNCTION WITH FINAL PAYMENT TO DU-MOR <br /> ENTERPRISES, INC. FOR COMPLETION OF THE DOWNTOWN <br /> WATER SYSTEM IMPROVEMENTS PROJECT; AUTHORIZING THE <br /> CITY MANAGER TO EXECUTE THE RELEASE OF SURETY FORM <br /> AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br /> 1. On June 27, 1994 the City Council approved <br />final payment to Du-Mor Enterprisesr Inc. for the completion <br />of the Downtown Water System Improvements Project subject to <br />the City's receipt of a Consent To Final Payment form from <br />Eagle Insurance CompanYr Du-Morrs bond surety. <br /> 2. Eagle Insurance Company is in receivership and <br />is requiring a Release of Surety form to be executed by the <br />City and provided to it in exchange for the Consent to Final <br />Payment. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: ~ <br /> PART 1. That the Release of Surety form attached <br />to this resolution is approved. <br /> PART 2. That the City Managerr Larry D. GilleYr <br />is authorized to execute the Release of Surety form on behalf <br />of the City. <br /> PART 3.
