<br />83 <br />Regular Meeting December 12, 1994 Page 2 <br />Council approves the issuance of a certificate, they will put the <br />insurance coverage into effect. When the City is provided their <br />proof of insurance, we will then issue the certificate. The Council <br />voted unanimously for adoption of the Resolution (Mr. Hart present <br />to vote on this matter - 7:35 p.m.). <br />Mr. Guerra introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ABANDONING AND VACATING A PORTION OF CORNELL STREET <br /> LOCATED ADJACENT TO LOTS 7A, 8A AND 8B OF BLOCK 7 OF THE <br /> MACNAUGHTON ADDITION; AUTHORIZING THE CITY MANAGER TO EXECUTE <br /> QUITCLAIM DEEDS TO THE ABUTTING PROPERTY OWNERS; AND DECLARING <br /> AN EMERGENCY. <br />Mr. Hart moved for adoption of the Ordinance on emergency and Mr. <br />Hernandez seconded the motion, which passed unanimously. <br />Mr. Guerra introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY O~ SAN MARCOS, <br /> TEXAS, AMENDING CHAPTER 25, STREETS, SIDEWALKS, RIGHT-OF-WAY <br /> CONSTRUCTION AND OFF-STREET PARKING, OF THE SAN MARCOS CODE OF <br /> ORDINANCES TO ADD AN ARTICLE VII, ABANDONMENT OF CITY STREETS <br /> AND ALLEYS; PROVIDING FOR SEVERABILITY; REPEALING ALL <br /> CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br /> PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br />Mr. Mooney moved for approval of the Ordinance on first reading and <br />Mr. Cox seconded the motion. The Council was advised the amendments <br />would result in reduced costs to the applicants, elimination of the <br />need for appraisals and a quicker process. The Council voted <br />unanimously for approval of the Ordinance on first reading. <br />Mr. Guerra introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING ARTICLE II, DEFINITIONS AND ARTICLE ~I, <br /> SUBDIVISION DESIGN REQUIREMENTS OF APPENDIX C - SUBDIVISIONS OF <br /> THE SAN MARCOS CODE OF ORDINANCES TO DEFINE "FLAG SHAPED LOTS" <br /> AND TO PROHIBIT SUCH LOTS WITHIN SUBDIVISIONS, INCLUDING <br /> PROCEDURAL PROVISIONS; AND PROVIDING PENALTIES FOR VIOLATIONS. <br />Mr. Mooney moved for approval of the Ordinance on first reading and <br />Mr. Cox seconded the motion. Mr. Patterson advised the Planning <br />and Zoning commission is trying to address a problem which <br />occasionally occurs and offering a variance process when the need <br />does occur (Mr. Moore present at this time - 7:53 p.m.). He stated <br />these lots cause problems with emergency access and there is <br />difficulty providing services. Mr. Hart stated he has reservations <br />regarding the amendment, because he does not want to prohibit <br />someone from using their own property. Mr. Cox stated one of the <br />problems with the flag shaped lots is causing a traffic bottleneck. <br />Mr. Hernandez stated he thinks it should be the option of the person <br />to buy such a lot and would want that flexibility allowed. Mr. <br />Moore stated irregular shaped lots have caused difficulties, and <br />emergency access is another concern. He stated we should create a <br />standard, then deviate when it is appropriate. On roll call the <br />following vote was recorded: <br /> AYE: Moore, Mooney, Guerra, Cox. <br /> NAY: Hart, Hernandez. <br />ABSTAIN: None. <br />The Ordinance was approved on first reading. <br />
