follows: <br />a. increase the limit on the number of freestanding on- premises signs under <br />Section 6.3.3 (a) (1) to four (inclusive of an oversized flag which is treated as a sign) to <br />allow the signs described in Exhibit `B "; <br />b. increase the permitted maximum surface area of freestanding on- premise <br />signs under Section 6.3.3.3 (a) (5) a.1. to allow such larger surface areas as provided for <br />each sign, as applicable, as described in Exhibit `B "; <br />C. increase the maximum height restriction on freestanding on- premise signs <br />under Section 6.3.3.3 (a) (4) a.l. to allow such greater heights for each sign, as <br />applicable, as described in Exhibit "B "; <br />Except as specifically stated above, the City grants no other waivers of requirements under the <br />Land Development Code and any signs erected by Developer shall conform in every other <br />respect to the requirements thereof. The foregoing waivers apply only to those signs described in <br />Exhibit `B ". <br />PART 4. DEFAULT AND EXPIRATION OF WAIVERS <br />Section 4.01. Default. The City Manager may declare a default under this Agreement <br />and may terminate this Agreement if Developer: <br />1. fails to complete the Project within the time specified in Section 2.01 <br />and/or fails to begin operation of the Business within the time specified in Section 2.02; <br />2. made or makes any representation relied upon by the City in entering into <br />this Agreement or in any request or submission to the City relating to this Agreement that <br />is false or misleading in any material respect; or <br />3. installs any signs not in conformance with the requirements of Sections <br />4 <br />
