STATE OF TEXAS <br />COUNTY OF HAYS <br />The City of San Marcos ( "City ") and Texas State University (the "University) hereinafter <br />collectively referred to as the "Parties" enter into this Interlocal Agreement under the authority of <br />the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended. <br />RECITALS: <br />WHEREAS, the City wishes to procure archaeological surveys and site assessments <br />related to various City Projects from the University; and <br />WHEREAS, it is in the interest of economy and efficiency, that the parties enter into a <br />cooperative program; and <br />NOW THEREFORE, in consideration of the mutual covenants and promises contained <br />herein, the parties agree as follows: <br />Section 1. Scope of Services <br />The University agrees to assist in the coordination and scheduling of archaeological <br />assessment of City projects. The University will meet quarterly or as requested, with the City <br />during the term of this Agreement regarding these services. In addition, the University will <br />perform archaeological surveys and site assessments (the "Services ") that may be required under <br />State or Federal law for the City on a per project basis upon notification by the City in <br />accordance with its Scope of Work attached to this Agreement as Attachment A. <br />Section 2. City Responsibilities <br />The City will be responsible for providing accurate project information for each project it <br />assigns, which may include GIS information, existing utility information, proposed design files, <br />preliminary engineering reports, etc. The City agrees to provide this information and render <br />decisions as expeditiously as possible for the orderly progress of University services. <br />Section 3. Compensation <br />A. Basic Services: The City agrees to pay the University a not to exceed total fee of <br />
