Mr. Moore stated he received community support for the Ordinance; however, some families showed concern with being fined because of children that were uncontrollable. The Council then voted unanimously for adoption of the Ordinance. Mayor Morris introduced for consideration, reconsideration of a Zoning Ordinance. " The -~~ Council did not wish to reconsider the Ordinance. The caption reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A TRACT OF PROPERTY 10.447 ACRES IN SIZE, MORE OR LESS, LOCATED AT 1606 IH-35 NORTH FROM "C" COMMERCIAL DISTRICT TO IIMF-5" MULTI-FAMILY DISTRICT (HIGH DENSITY) AND DECLARING AN EFFECTIVE DATE. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held August 8, 1994, approval of an Ordinance on second reading, adoption of eleven Resolutions, and approval of expenditures from the Tourist Account FY93-94 in the amount of $3,825.00 and FY94-95 in the amount of $553.00 on consensus. The Council removed items 9.C.(1), 9.C.(8) and 9.C.(10) to be considwed separately. Mr. Guerra moved for approval of the minutes of the Regular Meeting held on August 8, 1994, approval of an Ordinance on second reading, adoption of the remaining eight Resolutions, and approval of the expenditures from the Tourist Account in the amount of $3,825.00 for FY93-94 and $553.00 for FY94-95 on consensus and Mr. Moore seconded the motion, which passed unanimously. (Mr. Hernandez voted NAY on item 9.C.(9).). The captions of the Ordinance and Resolutions read as follows: Approval of Ordinance on second reading: - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-73(E) OF THE SAN MARCOS CODE OF ORDINANCES TO PROHIBIT MEMBERS OF THE PLANNING AND ZONING COMMISSIONS AND THE ZONING BOARD OF ADJUSTMENTS FROM REPRESENTING PRIVATE INTERESTS BEFORE THE CITY COUNCIL IN CERTAIN MATTERS; AND PROVIDING A PENALTY. Adoption of Resolutions: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER AGREEMENT BETWEEN THE CITY AND DX DISTRIBUTORS, INC., TO EXTEND THE TERM OF A CONTRACT FOR THE PURCHASE OF LIQUID CALCIUM HYPOCHLORITE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AWARDING A CONTRACT TO WATTHOUR ENGINEERING CO., INC. FOR THE PURCHASE OF AN ELECTRIC METER TEST BENCH; J AUTHORIZING THE PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AWARDING CONTRACTS FOR THE PURCHASE OF DISTRIBUTION OPEN FUSE CUTOUTS TO WESCO; AUTHORIZING THE PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE.
