Mr. Cox stated a parent called <br />him and said 11:00 is too late. Chief Kendrick stated it is a <br />standard curfew time on week nights and midnight all but school <br />nights. Mr. Moore moved to amend the Ordinance as per memorandum to <br />the Council from Colette Davis dated August 3, 1994, as follows: <br />Sec. 16-80. . . . (2) Curfew hours means: (A) 11:00 p.m. on any ~ <br />Sunday, Monday, Tuesday, Wednesday, or Thursday; and, (B) Midnight <br />until 6:00 a.m. on any day; and, (C) 9:00 a.m. until 2:30 p.m. on <br />any Monday, Tuesday, Wednesday, Thursday or Friday. . . . ", delete <br />(12) SMCISD means the San Marcos Consolidated Independent School <br />District," in Sec. 16-82 to amend (b) as follows, "It is a defense <br />to prosecute under section 16-81 with respect to the curfew hours <br />described in section 16-80(2) (C) above that: (1) the minor was a <br />high school graduate or has equivalent certification; (2) the minor <br />was on an excused absence from his or her place of schooling; or (3) <br />the minor's school was not in session," in Sec. 16-81 (c) as <br />follows, ". . . . Notice of Curfew Hours San Marcos city ordinance <br />Persons under 17 years of age are not to remain in this business <br />during the following hours: 1. Between 11:00 p.m. and midnight on <br />any Sunday, Monday, Tuesday, Wednesday, or Thursday. 2. Between <br />midnight at 6:00 a.m. of any day. violations may be reported to the <br />San Marcos Police Department," Sec. 16.83. . . . "(b) The parents of <br />a minor may be cited for violation of 16-81(b) upon the minor <br />receiving a second citation for violation of section 16-81(a)," and <br />Mr. Mooney seconded the motion, which passed unanimously. The <br />Council then voted unanimously for approval of the Ordinance on <br />second reading. <br /> <br />Mayor Morris introduced for consideration reconsideration of two <br />zoning Ordinances. The Council did not wish to reconsider the <br />Ordinances. The captions of the Ordinances read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A TRACT OF PROPERTY 10.05 ACRES IN SIZE, MORE OR LESS, LOCATED <br />AT 426 BROADWAY DRIVE, FROM "R-l" (SINGLE-FAMILY DWELLING <br />DISTRICT [LOW DENSITY]) TO "MF-2" (MULTI-FAMILY DISTRICT <br />[MEDIUM DENSITY]) AND DECLARING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A TRACT OF PROPERTY 2.0 ACRES IN SIZE, MORE OR LESS, LOCATED IN <br />THE 1400 BLOCK OF RIVER ROAD, FROM "PD" (PRE-DEVELOPMENT <br />DISTRICT) TO "MF-2" (MULTI-FAMILY DISTRICT [MEDIUM DENSITY]) <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration approval for consideration <br />of property tax increase at a public hearing to be conducted on <br />Tuesday, September 6, 1994, at 7:30 p.m. in the Council Chambers at <br />City Hall, 630 E. Hopkins Street. Mr. Moore moved for approval and <br />Mr. Mooney seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of minutes of the <br />Special Meeting held July 18, 1994 and Regular Meeting held July 25, <br />1994, adoption of an Ordinance on third and final reading, adoption <br />of two Resolutions, and approval for expenditures from contingency <br />Funds: (1) Water/Wastewater contingency Funds in the amount of <br />$15,000.00 for partial funding of the Parker Drive Project to help <br />cover the cost of the water extension, and (2) General Fund <br />contingency Funds in the amount of $46,800.00 for partial funding of <br />the Parker Drive Project to help cover the cost of streets on <br />consensus. The Council removed Item 13.D. (1), approval of <br />Water/Wastewater contingency Funds in the amount of $15,000.00 to be <br />considered separately. Mr. Hart moved for approval of the minutes <br />of the special Meeting held July 18, 1994 and Regular Meeting held <br />July 25, 1994 (Mr. Hart abstaining), adoption of the Ordinance on <br />third and final reading, adoption of the two Resolutions, and <br />approval for the expenditure from General Fund contingency Funds in <br />the amount of $46,800.00 on consensus and Mr. Moore seconded the <br />motion, which passed unanimously.
