RESOLUTION 2009- 88R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE SALE OF FOUR <br />TRACTS OF PROPERTY LOCATED AT 1006, 1008. 1010 AND <br />1012 GRAVEL STREET BY THE SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT AND <br />HAYS COUNTY, TRUSTEES; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. The San Marcos Consolidated Independent School District, as trustee for all local taxing <br />units, is the owner of two tracts of property located on Gravel Street (collectively the "Properties") <br />through a sheriffs sale of the Property for unpaid taxes. The two tracts are: <br />a. Lot 12, Block 4, Dan McKie First Addition, 1006 Gravel Street <br />b. West one-half of Lot 14 and all of Lot 15. Block 4, Dan McKie First Addition, 1012 <br />Gravel Street <br />2. Hays County, as trustee for all local taxing units, is the owner of two pieces of property <br />(collectively the "Properties") located on Gravel Street through a sheriffs sale of the Property for <br />unpaid taxes. The two tracts are: <br />a. Northeast one-half of Lot 13, Block 4, Dan McKie First Addition, 1008 Gravel <br />b. East one-half of Lot 14. Block 4. Dan McKie First Addition. 1010 Gravel <br />2. The San Marcos Consolidated Independent School District and Hays County have <br />received an offer of $1,000 for each of the four tracts making up the Properties from Mr. Jonathan S. <br />. Winkleman. This offer is less than the amount of taxes owed on the Properties, and less than the <br />appraised value of the Properties according to the Hays County Appraisal District. <br />3. The SMCISD Board of Trustees has approved the sale of the Properties for this bid, and <br />the Hays County Tax Assessor-Collector has forwarded the bid to the City Council for consideration. <br />4. City approval of the bid is necessary for the sale since the bid is for less than the amount <br />of taxes owed on the property. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The sale of the Properties by Hays County Trustee and the San Marcos <br />Consolidated Independent School District Trustee for $1,000 for each tract resulting in a total of <br />$4.000 is approved. <br />PART 2. The Mayor, Susan Narvaiz, is authorized to execute the deeds for this sale on <br />behalf of the City of San Marcos. <br />PART 3.
