Section 5: Performance Evaluation <br />A. The City Manager or designee shall review and evaluate the performance of Employee at <br />least annually. <br />B. The City Manager shall define goals and performance objectives determined necessary for <br />the position. <br />C. Merit consideration will be provided once each year subject to appropriation of funds for <br />performance-based pay increases in the current fiscal year budget. <br />D. Employee will continue his enrollment in the National Fire Executive Officer Program. <br />E. Employee will continue seeking a Bachelor's degree. <br />Section 6: Vacation, Sick, and Military Leave <br />A. Employee shall accrue and have credited to his personal account, vacation and sick leave at <br />the same rate as Exempt general employees of the City receive per year, which currently <br />includes 15 days of vacation that can be used after completing the 6-month introductory <br />period, 11 paid holidays, 1 floating holiday, 15 days of sick leave, and 6 days of personal <br />leave time. The City reserves the right to change this policy on a city-wide basis for all <br />Exempt employees. <br />B. Employee shall also receive 5 days of vacation effective immediately for the first year of <br />employment. <br />C. Employee shall be entitled to military leave pursuant to Federal or State law and City <br />policies. <br />Section 7: Employee Benefits <br />The City shall provide for Employee's participation in the City of San Marcos retirement plan <br />through the Texas Municipal Retirement System in a manner consistent with all other employees <br />of the City. The City agrees to provide employee benefits for medical, dental, life insurance, and <br />disability in accordance with normal City policies for general employees unless otherwise <br />provided in this document. City reserves the right to amend such policies from time to time. <br />Employee understands that nothing in this Agreement shall be deemed to confer vested property <br />rights to continuation of employment or continuation of benefits. <br />Section 8: Outside Activities & Employment <br />Employee shall not spend more than 10 hours per week in teaching, consulting or other non City <br />connected business or employment without the prior approval of the City Manager or designee. <br />Section 9: Dues and Subscriptions <br />The City agrees to budget and to pay for professional dues and subscriptions necessary for <br />Employee's continued professional participation, growth, and advancement, and for the good of <br />the City. <br />Section 10: Indemnification <br />The City shall provide for indemnification and defense of the Employee in accordance with the <br />provisions found in the San Marcos City Code, Section 2.374. The City shall bear the full cost <br />of any fidelity or other bonds or other insurance required of the Employee under law or <br />ordinance by virtue of this employment. <br />Page 2 of 5
