.i. s <br />The State of Texas City Secretary <br />County of Hays Contract # <br />INTERLOCAL AGREEMENT <br />BETWEEN THE CITY OF SAN MARCOS, TEXAS AND COUNTY OF HAYS, TEXAS <br />JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This Agreement is made and entered into this day of?;4_, 2009, by and between the <br />COUNTY of Hays, acting by and through its governing body, the Commissioners Court, hereinafter <br />referred to as COUNTY, and the CITY of San Marcos, acting by and through its governing body, the City <br />Council, hereinafter referred to as CITY, both of Hays County, State of Texas, witnesseth: <br />WHEREAS, this Agreement is made under the authority of the Interlocal Cooperation Act, Chapter 791 <br />of the Texas Government Code, as amended: and <br />WHEREAS, each governing body, in performing governmental functions or in paying for the <br />performance of governmental functions hereunder, shall make that performance or those payments from <br />current revenues legally available to that party: and <br />WHEREAS, each governing body finds that the performance of this Agreement is in the best interest of <br />both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates <br />the performing party for the services or functions under this agreement: and <br />WHEREAS, the CITY agrees to provide the COUNTY with $14,761, one-half of the total $29,522 JAG <br />award. The CITY agrees to submit the joint grant application and be the fiscal agent for the grant: and <br />WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate JAG funds in a <br />50-50 share. The CITY agrees to use $14,761 in grant funds for law enforcement programs. The <br />COUNTY agrees to use $14,761 in grant funds for law enforcement programs. <br />NOW THEREFORE, the COUNTY and CITY agrees as follows: <br />Section 1. <br />CITY agrees to pay COUNTY a total of $14,761 of the total $29,522 JAG funds.
