<br /> 113 <br /> Regular Meeting June 13, 1994 Page 4 <br /> AYE: Moore, Mooney, Hart, Guerra, Cox. <br /> NAY: Hernandez. <br /> ABSTAIN: None. <br /> Mr. Guerra introduced for consideration a public hearing and <br /> adoption of a Zoning Ordinance, the caption which was read as <br /> follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br /> 17.74 ACRES TRACT OF PROPERTY, LOCATED IN THE 1200 BLOCK OF <br /> WONDER WORLD DRIVE, FROM "LB" (LIMITED BUSINESS DISTRICT) AND <br /> "C" (COMMERCIAL DISTRICT) TO "MF-5" (MULTI-FAMILY DISTRICT <br /> [HIGH DENSITY]) AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Guerra opened the public hearing and asked if anyone wished to <br /> speak for or against the zoning amendment. Jim Byrn was present <br /> representing Ms. Hood and was there to answer any questions. No one <br /> else wished to speak, so Mr. Guerra closed the .public hearing. Mr. <br /> Moore moved for adoption of the Zoning Ordinance and Mr. Mooney <br /> seconded the motion, which passed unanimously. < <br /> Mr. Guerra introduced for consideration adoption of an Ordinance on <br /> emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br /> FISCAL YEAR TO PROVIDE FUNDING FOR THE SINK CREEK WASTEWATER <br /> INTERCEPTOR AND NORTHWEST WATER SYSTEM IMPROVEMENTS PROJECTS; <br /> AND DECLARING AN EMERGENCY. <br /> Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br /> Cox seconded the motion. The Northwest Water System Project is for <br /> storage and a water main and the Sink Creek Project is not yet fully <br /> funded as a project. The Council voted unanimously for adoption of <br /> the Ordinance on emergency. <br /> Mr. Guerra introduced for consideration adoption of an Ordinance on <br /> emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING ARTICLE IA, WATER CONSERVATION, OF CHAPTER 30, <br /> WATER AND SEWERS AND SEWAGE DISPOSAL, OF THE SAN MARCOS CODE OF <br /> ORDINANCES TO INCREASE THE EDWARDS AQUIFER LEVELS AT WHICH <br /> STAGES 1 THROUGH 4 OF THE CITY'S WATER CONSERVATION REGULATIONS <br /> MAY BE IMPLEMENTED; PROVIDING FOR SEVERABILITY; REPEALING ALL <br /> CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br /> PUBLICATION; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br /> Cox seconded the motion. A year ago Judge Bunton asked Fish and <br /> wildlife to study the levels when the endangered species in the <br /> Comal springs would begin to die, and the flow level when the Comal <br /> Springs dries up. Recently they have provided Judge Bunton with <br /> their findings. The impact of this Ordinance amendment will be to <br /> implement conservation measures sooner (at higher levels). Although <br /> the conservation measures will be more strict, Judge Bunton can <br /> still ask us to do more. On roll call the following vote was <br /> recorded: <br /> AYE: Moore, Hart, Guerra, Cox, Hernandez. <br /> NAY: Mooney. <br /> ABSTAIN: None. <br />
