City Council Meeting Minutes July 5, 2016 <br />The Council reconviened at 5:40 p.m. The Council provided direction to Staff <br />in Executive Session. No futher action was taken. <br />PRESENTATIONS <br />3. Receive a Staff presentation and hold discussion regarding revisions to the San <br />Marcos City Code Chapter 39: Flood Damage Prevention Ordinance, and provide <br />direction to Staff. <br />Richard Reynosa, Senior Engineer, provided the Council with a presentation of <br />proposed changes to Chapter 39 - Flood Prevention of the San Marcos City <br />Code. The Council held discussion regarding the word "substantially" as it <br />applies to no -rise to floodplain elevations. Staff will adjust the language by <br />striking the word "substantially." Staff to give some idea of what the costs <br />would be for City analysis and to have an approved list to be used for the 2 -D <br />analysis done by developers. Council held discussion regarding exceptions for <br />infill, small lots and single family lots. Staff will look at more data to bring <br />back for Council to consider related to possible exceptions. Staff will also <br />define what a single family lot and small lot, and will provide a fee schedule. <br />Council held discussion regarding the potential for a variance on the elevation <br />above base flood elevation (BFE) and requiring different areas to elevate to <br />different heights based on location. Council provided direction to change the <br />elevation from 1ft of elevation above BFE to 2ft of elevation above BFE. Staff <br />will include additional language requiring developments to design roadway <br />access at or above the base flood elevation in the ordinance. Council Member <br />Prewitt requested for a map illustrating 18 inches vs. 24 inches elevations and <br />what percentage of the population would be in the floodplain as a result of <br />those changes. Council provided consensus with regard to the Working Flood <br />Model. Staff to check and see if fees are charged on a per day basis regarding <br />the failure to comply with drainage requirements. Council provided consensus <br />to establish a Floodplain Buffer. Council discussed detention ponds, <br />underground storage, dumpters and enclosure standards. Staff will look into <br />higher enclosures standards related to dumpsters. Council provided consensus <br />regarding proposed revisions to fill, compensatory storage, and materials <br />storage. <br />4. Receive an update from Texas Municipal League (TML) on Legislative issues, and <br />provide direction to Staff regarding the City's Legislative Program for the 2017 Regular <br />Session of the Texas Legislature. <br />Bennett Sandlin, Director of Texas Municipal League (TML), provided the <br />Council with an overview of TML and their timeline for legislative issues <br />being provided to the TML Resolutions Committee to review.
