RESOLUTION 2016-99R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, REPLACING THE ORIGINAL ADVANCE FUNDING <br /> AGREEMENT AND APPROVING THE REPLACEMENT ADVANCE <br /> FUNDING AGREEMENT FOR A LOCAL TRANSPORTATION PROJECT <br /> (CSJ-0914-33-032) BETWEEN THE CITY AND THE STATE OF TEXAS <br /> ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION <br /> ("TXDOT") FOR THE SESSOM DRIVE IMPROVEMENTS PROJECT; <br /> INCREASING THE CITY'S LOCAL PARTICIPATION CONTRIBUTION <br /> FROM $821,500.00 TO $1,550,008.00; AUTHORIZING THE CITY <br /> MANAGER OR HIS DESIGNEE TO EXECUTE THIS REPLACEMENT <br /> ADVANCE FUNDING AGREEMENT ON BEHALF OF THE CITY AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On February 7, 2006 the City Council approved a Local Transportation Project Advance <br /> Funding Agreement ("AFA") with the State of Texas acting through the Texas Department of <br /> Transportation ("TxDOT") for the Sessom Drive Improvements Project (CSJ#0914-33-032). <br /> 2. On July 25. 2006 the City administratively approved Amendment No. 1 to the AFA for <br /> the Sessom Drive Improvements Project and on August 19.2014 the City approved Amendment No. <br /> 2 to the same AFA. <br /> 3. In order to meet current federal standards and because there has been a revision to the <br /> project limits, TxDOT wishes to replace the original AFA for the Sessom Drive Project with the <br /> attached replacement AFA for the Sessom Drive Improvements Project in order to better reflect the <br /> necessary changes. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached Local Transportation Project Advance Funding Agreement (CSJ- <br /> 0914-33-032) for the Sessom Drive Improvements Project which replaces the original AFA for the <br /> same project is approved. <br /> PART 2. An increase in the local participation contribution front $821,500.00 to <br /> $1,550.008.00 for the Sessom Drive Improvements Project is approved. <br /> PART 3. The City Manager or his designee is authorized to execute the replacement AFA <br /> for the Sessom Drive Improvements Project. <br /> 1 <br />
