<br />65 <br />Regular Meeting May 9, 1994 Page 2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE PURCHASE OF A VEHICLE <br />FOR THE W.I.C. PROGRAM; AND DECLARING AN EMERGENCY. <br /> --- <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Guerra <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an Ordinance on second <br />reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING AN ORDINANCE ADOPTED ON MARCH 28, 1994 <br />ESTABLISHING INDUSTRIAL USER PERMIT FEES, LIQUID WASTE HAULER <br />REGISTRATION AND WASTE RECEIVING FEES, WASTE SURCHARGE <br />FEES, MINIMUM MONTHLY CHARGE FOR SURCHARGE PROGRAM <br />PARTICIPANTS AND WASTE SAMPLING FEES PURSUANT TO THE <br />INDUSTRIAL WASTE DISCHARGE REGULATIONS ARTICLE OF CHAPTER <br />30, WATER AND SEWERS AND SEWAGE DISPOSAL, OF THE SAN MARCOS <br />CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING <br />FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on second reading and Mr. Guerra <br />seconded the motion. Mayor Morris asked if 300 COD was the standard level for grab <br />sample testing under the Surcharge Ordinance. Mr. Gilley stated that was correct, <br />and after the initial grab sample, if the COD level was between 300 and 400 then the <br />composite sample would be taken. Mayor Morris asked why the annual testing fee <br />remained $25.00 a month. Mr. Boeker stated the sampling test costs the City $25.00. <br />Discussion ensued. The Council requested a breakdown on what the charges for <br />testing per month covered. Mr. Hernandez asked if the EPA had been contacted to <br />distinguish which businesses fell under the compliance of this Ordinance. Mayor <br />Morris stated EPA had been contacted and they defined what the City's legal <br />responsibility was towards EPA and how industrial users were defined by the EPA. Mr. <br />Moore moved to amend Section 3(b)(1) to read :.' . testing fees under subsection (e) <br />below, if their discharge.. and Section 3(e)(3) to read. .. under subsection (e)(2) <br />above, . .. Mayor Morris seconded the motion, which passed unanimously. The <br />Council then voted unanimously for approval of the Ordinance on second reading. <br />Mayor Morris introduced for consideration approval of minutes of the Regular Meeting <br />held April 25, 1994, approval of minutes of the Special Meeting held May 2, 1994, and <br />adoption of six Resolutions on consensus. Mr. Guerra moved for approval of the <br />minutes of the Regular Meeting held April 25, 1994, (Mr. Hernandez abstaining on this <br />item) approval of the minutes of the Special Meeting held May 2, 1994, (Mr. <br />Hernandez and Mr. Cox abstaining on this item) and adoption of the six Resolutions on <br />consensus and Mr. Moore seconded the motion, which passed unanimously. The <br />captions of the Resolutions read as follows: ¡ <br />Adoption of Resolutions: \ <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF A PICKUP TRUCK FOR THE WIC <br />PROGRAM FROM KNAPP CHEVROLET; AUTHORIZING THE PURCHASING <br />MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE <br />CITY AND DECLARING AN EFFECTIVE DATE. <br />
