65 Regular Meeting May 9, 1994 Page 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 FISCAL YEAR TO PROVIDE FUNDING FOR THE PURCHASE OF A VEHICLE FOR THE W.I.C. PROGRAM; AND DECLARING AN EMERGENCY. --- Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Guerra seconded the motion, which passed unanimously. Mayor Morris introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING AN ORDINANCE ADOPTED ON MARCH 28, 1994 ESTABLISHING INDUSTRIAL USER PERMIT FEES, LIQUID WASTE HAULER REGISTRATION AND WASTE RECEIVING FEES, WASTE SURCHARGE FEES, MINIMUM MONTHLY CHARGE FOR SURCHARGE PROGRAM PARTICIPANTS AND WASTE SAMPLING FEES PURSUANT TO THE INDUSTRIAL WASTE DISCHARGE REGULATIONS ARTICLE OF CHAPTER 30, WATER AND SEWERS AND SEWAGE DISPOSAL, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. Mr. Moore moved for approval of the Ordinance on second reading and Mr. Guerra seconded the motion. Mayor Morris asked if 300 COD was the standard level for grab sample testing under the Surcharge Ordinance. Mr. Gilley stated that was correct, and after the initial grab sample, if the COD level was between 300 and 400 then the composite sample would be taken. Mayor Morris asked why the annual testing fee remained $25.00 a month. Mr. Boeker stated the sampling test costs the City $25.00. Discussion ensued. The Council requested a breakdown on what the charges for testing per month covered. Mr. Hernandez asked if the EPA had been contacted to distinguish which businesses fell under the compliance of this Ordinance. Mayor Morris stated EPA had been contacted and they defined what the City's legal responsibility was towards EPA and how industrial users were defined by the EPA. Mr. Moore moved to amend Section 3(b)(1) to read :.' . testing fees under subsection (e) below, if their discharge.. and Section 3(e)(3) to read. .. under subsection (e)(2) above, . .. Mayor Morris seconded the motion, which passed unanimously. The Council then voted unanimously for approval of the Ordinance on second reading. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held April 25, 1994, approval of minutes of the Special Meeting held May 2, 1994, and adoption of six Resolutions on consensus. Mr. Guerra moved for approval of the minutes of the Regular Meeting held April 25, 1994, (Mr. Hernandez abstaining on this item) approval of the minutes of the Special Meeting held May 2, 1994, (Mr. Hernandez and Mr. Cox abstaining on this item) and adoption of the six Resolutions on consensus and Mr. Moore seconded the motion, which passed unanimously. The captions of the Resolutions read as follows: ¡ Adoption of Resolutions: \ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PURCHASE OF A PICKUP TRUCK FOR THE WIC PROGRAM FROM KNAPP CHEVROLET; AUTHORIZING THE PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE.
