<br />115 <br /> <br />Regular Meeting <br /> <br />March 28, 1994 <br /> <br />Page 2 <br /> <br />Mayor Morris introduced a public hearing and adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, DENYING A PETITION BY THE PEDERNALES ELECTRIC <br />COOPERATIVE FOR AUTHORITY TO CHANGE ITS RATES; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the Resolution. No one wished to speak, so <br />Mayor Morris closed the public hearing. Mr. Mooney moved for <br />adoption of the Resolution and Mr. Moore seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Morris~introduced for consideration adoption of an Ordinance <br />on emergency; the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br />FISCAL YEAR TO PROVIDE FUNDING FOR A COST SHARING AGREEMENT FOR <br />UTILITY IMPROVEMENTS WITH SAN MARCOS CONSOLIDATED INDEPENDENT <br />SCHOOL DISTRICT AND TETCO INC.; AND DECLARING AN EMERGENCY. <br />. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Hart seconded the motion. The City will pay for overage for water <br />and sanitary sewage to serve other development in the area. The <br />lines will accommodate the Schools, TETCO and other development. <br />The Council voted unanimously for adoption of the Ordinance on <br />emergency. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br />FISCAL YEAR TO PROVIDE FUNDING FOR ADDITIONAL ENGINEERING <br />SERVICES FOR THE WASTEWATER SYSTEM MASTER PLAN; AND DECLARING <br />AN EMERGENCY. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion. These funds will provide for <br />reinstallation of monitors for an eight-week period if we get <br />sufficient rainfall before the end of their contract period. The <br />Council voted unanimously for adoption of the Ordinance on <br />emergency. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING INDUSTRIAL USER PERMIT FEES, LIQUID WASTE <br />HAULER REGISTRATION AND WASTE RECEIVING FEES, WASTE SURCHARGE <br />FEES, MINIMUM MONTHLY CHARGE FOR SURCHARGE PROGRAM PARTICIPANTS <br />AND WASTE SAMPLING FEES PURSUANT TO THE INDUSTRIAL WASTE <br />DISCHARGE REGULATIONS ARTICLE OF CHAPTER 30, WATER AND SEWERS <br />AND SEWAGE DISPOSAL OF THE SAN MARCOS CODE OF ORDINANCES; <br />PROVIDING FOR BILLING PROCEDURES; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY; <br />PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Cox seconded the motion. Mr. Taylor advised the <br />Council there is a broad range of options in implementing a <br />surcharge program. Public Works recommended a permit process not be <br />used. Mr. Boeker stated it is his opinion we have to have a <br />surcharge program with our EPA permit. EPA required the city have a <br />surcharge program. The surcharge program provides an incentive for <br />people not to put contaminants in the wastewater system. The $27.00 <br />charge is the minimum to cover testing only. Mr. Hart stated <br />carwashes and washaterias will not be under the limits and will pay <br />a surcharge. He thought restaurants could separate wastes and <br />possibly control what goes in the wastewater system, but some will <br />
