<br />l 109 <br /> <br /> <br />Regular Meeting March 7, 1994 Page 2 <br /> <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING INDUSTRIAL USER PERMIT FEES, LIQUID WASTE <br />HAULER REGISTRATION AND WASTE RECEIVING FEES, WASTE SURCHARGE <br />FEES, MINIMUM MONTHLY CHARGE FOR SAMPLING FEES PURSUANT TO THE <br />INDUSTRIAL WASTE DISCHARGE REGULATIONS ARTICLE OF CHAPTER 30, <br />WATER AND SEWERS AND SEWAGE DISPOSAL, OF THE SAN MARCOS CODE OF <br />ORDINANCES; PROVIDING FOR BILLING PROCEDURES; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING <br />FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />Mr. Mooney seconded the motion. Mr. Hart moved to amend the <br />Ordinance in section 4. (a) (Sec. 30-99) to read as follows: "(a) <br />Calculations of sewer surcharges on users served by metered water <br />shall be based on water usage, while surcharge calculations for <br />users not served by metered water shall be based upon wastewater <br />volume discharged to the sewer system," and Mr. Moore seconded the <br />motion, which passed unanimously. Mr. Hart asked for the Council to <br />be advised if our Ordinance complies with Federal law. Mr. Hart <br />asked the cost of treating above the allowed amounts and was advised <br />69 cents per pound pays the costs of treatment. Administration <br />costs were discussed. Paul Terry stated he was advised the $27.00 <br />per month fee includes costs of testing and administering the <br />surcharge process. The Council voted unanimously for approval of <br />the Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration approval of minutes of the <br />Regular Meeting held February 28, 1994 and adoption of two <br />Resolutions on consensus. The Council removed Item 7.B.(2) to be <br />considered separately. Mr. Hart moved for approval of the minutes <br />of the Regular Meeting held February 28, 1994 and adoption of the <br />Resolution on consensus and Mr. Moore seconded the motion, which <br />passed unanimously. The caption of the Resolution reads as follows: <br /> <br />Adoption of Resolution: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SUPPORTING THE DESIGNATION OF INTERSTATE HIGHWAY 35 AS <br />THE NAFTA HIGHWAY; SUPPORTING THE PROVISION OF APPROPRIATE <br />FEDERAL AND STATE FUNDING TO IMPROVE THE NAFTA HIGHWAY AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration Item 7.B.(2) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, NOMINATING A CANDIDATE FOR THE APPRAISAL REVIEW BOARD OF <br />THE HAYS COUNTY APPRAISAL DISTRICT TO FILL A VACANCY FOR A TERM <br />TO EXPIRE ON DECEMBER 31, 1994; DIRECTING THE CITY MANAGER TO <br />SUBMIT THE NAME OF THE NOMINEE TO THE CHIEF APPRAISER OF THE <br />HAYS COUNTY APPRAISAL DISTRICT; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for adoption of the Resolution and Mr. Hart seconded <br />the motion. Mr. Moore moved to amend the Resolution to insert the <br />name of Aart Millecam in PART 1 as a nomination to fill a vacancy <br />and Mr. Hart seconded the motion, which passed unanimously. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced the city Manager's Report. Mr. Ortega had <br />no report at this meeting. <br /> <br />Mayor Morris introduced the City Attorney's Report. Ms. Davis had <br />no report at this meeting. <br />
