Regular Meeting February 10, 1997 Page 2 <br />problems showing any respectable evidence of efficient treatment with medical marijuana. <br />Ms. Porter stated marijuana has various side effects and can also contain bacteria that <br />causes infections in humans. Ms. Porter stated instead of helping already ill cancer <br />patients, it may serve to further weaken their immune system. Mr. Brian Brown stated he <br />supported Mr. Ginsburg for standing up for what he believes in. Mr. Brown stated he <br />disagrees and felt the benefits of medical use of marijuana outweigh the hazards that are <br />posed to American citizens and younger generations of Americans that are coming <br />forward. <br />I <br />Mayor Moore introduced an Executive Session pursuant to Government Code, <br />Section 555.071, to discuss matters where the City Attorney's ethical duty to the City <br />clearly conflicts with Government Code, Chapter 551 (marijuana initiative petition). Mr. <br />Hernandez moved to adjourn into Executive Session at 7:53 p.m. and Ms. Hughson <br />seconded the motion, which passed unanimously. <br />Mr. Hernandez moved to reconvene at 8:46 p.m. and Ms. Hughson seconded the <br />motion, which passed unanimously. <br />Mayor Moore introduced the receiving of an Initiative Petiton for Ordinance for <br />Therapeutic Marijuana Use for Serious Medical Disorders. City Secretary Janis Womack <br />certified the petition submitted by Dr. Harvey Ginsburg as having sufficient signatures in <br />the amount of 1648 of registered voters, a copy of the certification is attached hereto. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, <br />the caption which was read as follows: <br />AN ORDINANCE ORDERING A JOINT GENERAL AND SPECIAL <br />ELECTION BY THE CITY AND THE SAN MARCOS CONSOLIDATED <br />INDEPENDENT SCHOOL DISTRICT TO BE HELD ON MAY 3, 1997 FOR <br />THE PURPOSE OF ELECTING A,CITY COUNCIL MEMBER, PLACE 5, <br />AND A CITY COUNCIL MEMBER, PLACE 6; AND TO BE HELD WITHIN f <br />THE BOUNDARIES OF THE SCHOOL DISTRICT FOR THE PURPOSE OF <br />ELECTING TWO SCHOOL DISTRICT BOARD OF TRUSTEES MEMBERS <br />AT LARGE; ESTABLISHING EARLY VOTING LOCATIONS AND POLLING <br />PLACES FOR THE ELECTION; AND MAKING PROVISIONS FOR THE <br />CONDUCT OF THE ELECTION. <br />Mr. Hernandez moved for approval of the Ordinance on emergency and Mr. Mihalkanin <br />seconded the motion. Mr. Mihalkanin moved to amend the ordinance on page 3 to change <br />the dates for the voting at the SWT Catholic Student Center to change the election dates <br />from April 23rd and 24th to April 16th and 17th and on page 4 to change the election date <br />for the Redwood Baptist Church from April 25th to April 24th; change the election date for <br />the San Marcos High School from April 28th to April 25th; change the election date for the <br />Hernandez Intermediate date from April 29th to April 28th and to put in a date for the Miller <br />Junior High School of April 29th. Mr. Cox seconded the motion. Mr. Mihalkanin stated the <br />reasoning for the change of date at the Student Center was that in talking to people they <br />believed they would have potentially more voters earlier in the semester even though it <br />was just one week. Ms. Womack stated the other dates are just corrections. On roll call <br />the following vote was recorded: <br />AYE: Hart, Moore, Guerra, Cox, Hernandez, Mihalkanin, Hughson <br />NAY: None <br />ABSTAIN: None <br />Mayor Moore stated that Council in Executive Session had discussed the initiative petition <br />and options that were available to them. Mayor Moore stated that the Charter states that <br />upon receipt of a qualified number of signatures the City Council shall accept the petition <br />and shall report it verbatim and shall put it at the nearest general election for the vote of
