Mr. <br />Gilley stated the Commission would probably take action on this some time in August. Mr. <br />Gilley stated the Council needed to direct staff how to organize to form support for this. <br />Mr. Guerra asked if the Commission had requested the City to come up with a difference <br />of money. Mr. Gilley stated the additional cost of the project is $1.8 million and the City <br />would need to come up with at least part of that amount. Mayor Moore stated the Council <br />needed to discuss some alternatives. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this <br />meeting. <br />Mayor Moore introduced the City Council's Report. (1) Mr. Cox asked Mr. Gilley <br />where the City was regarding the Master Plan section regarding annexation. Mr. Gilley <br />stated the process has changed from the last annexation and the Master Plan is off <br />schedule. Mr. Gilley stated staff can bring proposals where the City needs to look at <br />annexing. Mr. Gilley stated Legislative bills may change annexation by cities. Mr. Cox <br />stated he would like to look at this after the Legislative session ends. (2) Mr. Hernandez <br />wanted to asked about the KIND radio station operating illegally and what can the City do <br />about it. Mr. Hernandez stated he has neighbors complaining about the problems it has <br />created such as traffic. Mr. Hernandez stated the address was 503 Patricia. Mr. Gilley <br />stated the issue the City would be concerned about is the zoning. Mr`. Gutierrez informed <br />the Council three violations had been issued to Joe Ptak for home occupation without a <br />legal permit and is scheduled for court this week. Ms. Womack stated he had contacted <br />her about him playing the Council meeting tapes on his station. Mr. Gutierrez stated the <br />only issue he would be prosecuting is the home occupation and broadcasting has no <br />effect. (3) Mr. Guerra stated he had visited the San Marcos African American Museum and <br />was impressed with the quality of items which represented San Marcos. Mr. Guerra stated <br />he would like to discuss at the next Council meeting the use policy of the facility and would <br />like to designate the Calaboose as a museum so those people who have their historical <br />artifacts there do not have to move them in and out when the building is used. Mr. Guerra <br />stated he would like to have invitations extended to Ms. Armstead and Ms. Stovall for them <br />to present a discussion on this issue. (3) Ms. Hughson informed the Council the Texas <br />Department of Transportation would have their next meeting to receive comments on the <br />rural TIP in Bastrop, April 21st at 6:30 p.m. <br />Mayor Moore introduced an Executive Session pursuant to the Government Code, <br />Chapter 551.071, to discuss matters where the City Attorney's ethical duty to the City <br />clearly conflicts with Government Code, Chapter 551 (development incentive proposal; <br />Municipal Airport; Aquarena Springs Taxation), and Sections 551.072 and 551.073, to <br />discuss purchase of real property (surface water treatment plant site). Mr. Hernandez <br />moved to adjourn into Executive Session at 11:33 p.m. and Mr. Mihalkanin seconded the <br />motion, which passed unanimously. <br />Mr. Hernandez moved to reconvene at 12:20 a.m. and Mr. Mihalkanin seconded the <br />motion which passed unanimously.
